Theft of services-prima facie evidence.

A BILL

 

for

 

 1  AN ACT relating to theft of services; providing for prima
 2  facie evidence of the crime; and providing for an effective
 3  date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 6-3-408 by creating a new subsection
 8  (e) is amended to read:

 9 

10         6-3-408.  Theft of services; penalties; prima facie
11  evidence.

12 

13         (e)  Proof that a person who obtained services for use
14  at a premises vacated the premises without paying any
15  outstanding charges for the services and failed to pay the
16  charges for the services not later than five (5) days after
17  receiving notice of the failure to pay personally given or

 1  sent by certified United States mail, return receipt
 2  requested to the premises and forwarded to the address left
 3  with the United States post office, if any, and to any
 4  forwarding address left with the owner or purchaser of the
 5  premises, if any, is prima facie evidence that the person
 6  at the time he obtained the services with the intent to
 7  defraud.

 8 

 9         Section 2.  This act is effective July 1, 2001.
