Intensive supervision-domestic violence offenders.

A BILL

 

for

 

 1  AN ACT relating to criminal procedure; authorizing
 2  intensive probation supervision for specified domestic
 3  violence offenses; and providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 7-13-1105(a)(intro) and  by creating
 8  a new subsection (c) is amended to read:

 9 

10         7-13-1105.  Placement of probationer in program by
11  sentencing court.

13         (a)  A district court may, as a condition of
14  probation, order that a defendant who has entered a plea of
15  guilty or nolo contendere to or has been convicted of a
16  felony, or any offense defined by subsection (c) of this

 1  section, participate in a program established under this
 2  article, provided:

 3 

 4         (c)  Subject to the conditions specified in subsection
 5  (a)(i) through (iv) of this section, participation in a
 6  program established under this article may be ordered for a
 7  defendant who has entered a plea of guilty or nolo
 8  contendere to or has been convicted of a violation of W.S.
 9  6-4-404, or a violation of W.S. 6-2-501(a), (b), (e) or
10  (f)(i) or 6-2-504(a) or (b) if the defendant and the victim
11  are household members as defined by W.S. 35-21-102(a)(iv).

13         Section 2.  This act is effective immediately upon
14  completion of all acts necessary for a bill to become law
15  as provided by Article 4, Section 8 of the Wyoming
16  Constitution.
