A BILL
for
1 AN ACT relating to school districts;
specifying that
2 personal information pertaining to school
district
3 employees is confidential; prohibiting
school district
4 officials or employees from selling or
distributing this
5 information; providing an exception;
imposing a penalty;
6 and providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:

10 Section 1. W.S. 21-3-132 is created to read:
11

21-3-132. Personal information
pertaining to school
13 district
employees; confidential; prohibition against
14 selling
or distributing such information; exception;
15 penalty.

(a) Personal information or records pertaining to
3 school district employees is confidential. No
school
4 district official or employee shall sell or
otherwise
5 distribute personal information or records with
respect to
6 the employees of the school district expect as
provided by
7 subsection (b) of this section.

(b) Notwithstanding subsection (a) of this section,
10 personal information or records pertaining to school
11 district employees may be sold or distributed if:
12
13
(i) The employee who is the person in
interest
14 of the information or record to be sold or
distributed
15 consents in writing to the sale or distribution of
the
16 information or record pertaining to him; or
17

(ii) The sale or distribution of the
information
19 or record is required by law.

(c) Any school district official or employee who
22 sells or distributes information or records
pertaining to a
23 school district employee in violation of subsection
(a) of
24 this section is guilty of a misdemeanor and upon

1 conviction, is subject
to a fine of not more than seven
2 hundred fifty dollars ($750.00), imprisonment
for not more
3 than six (6) months, or both.

5 (d) For purposes of this section:

(i) "Person in interest" means
the person who is
8 the subject of the information or record, or any
9 representative designated by the person;
10

(ii) "Personal information or
record" means the
12 names, addresses and telephone numbers of employees
of the
13 school district and any information contained in
records
14 specified under W.S. 16-4-203(d)(i), (iii) and (iv).

Section 2. This act is
effective immediately upon
17 completion of all acts necessary for a bill to become
law
18 as provided by Article 4, Section 8 of the Wyoming
19 Constitution.
