Lawful fencing.

A BILL
for
1 AN ACT relating to
agriculture and animals; providing for
2 lawful
fencing as specified; and providing for an effective

date.

5 Be It Enacted by the Legislature of the State of Wyoming:

7 Section
1. W.S. 11-28-102(a)(i) and (b) is amended to
8
read:
9
10 11-28-102. Lawful fences generally.
11
12 (a) The following are lawful fences in this state:
13
14 (i) A fence made of constructed
and maintained
15 with
steel, concrete or sound wooden posts and three (3)
16 four
(4) tightly stretched and securely fastened spans of

1 barbed
wire with the top span not less than forty-eight
2 (48) inches above the ground and the
remaining spans
3 fastened not more than
fifteen (15) inches or less than ten 4
(10) eight (8) inches apart, or two (2) three (3)
spans of
5 barbed
wire with a wooden rail on top. Wooden posts shall
6 be
at least four (4) inches in diameter. Posts shall be set
7
firmly in the ground, at least twenty (20) inches deep, at
8 no
greater distance apart than twenty-two (22) sixteen and
9 one-half (16 1/2) feet between the posts or
thirty-three
10 (33) feet with at least two (2) iron or
wooden stays
11 between the posts. Stays shall be placed
equal distance
12 apart from themselves and the post on either
side;

14 (b) All other
fences made and constructed of boards,
15 rails, poles, stones, hedge plants or other
material which
16 upon evidence is declared to be as strong
and well
17 calculated to protect enclosures, and is as
effective for
18 resisting breaching stock as those described
in subsection
19 (a) of this section, shall be considered a
lawful fence.
20 For purposes of
W.S. 11-28-108, any river, hedge, mountain
21 ridge, bluff or
other natural barrier over or through which
22 livestock may not
pass shall be considered a lawful fence.
