Predator control fees.

A BILL

 

for

 

 1  AN ACT relating to agriculture and animals; increasing the
 2  predator control fee on cattle as specified; and providing
 3  for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

           7  Section 1.  W.S. 11-6-210(a) is amended to read:

 8 

 9         11-6-210.  Creation of predatory animal district fund;
10  predatory animal control fees; donations; appropriation by
11  county commissioners.

13         (a)  At the time of collecting brand inspection fees
14  imposed under W.S. 11-20-401 and 11-20-402, the brand
15  inspector shall collect predatory animal control fees on
16  all sheep and cattle inspected within each predatory animal

 1  district. However, predator control fees shall not be
 2  collected on cattle and sheep shipped into this state for
 3  immediate sale or slaughter. The amount of the fee for each
 4  predatory animal district shall be established by each
 5  predatory animal district board in consultation with the
 6  state predatory animal advisory board and shall not exceed
 7  eighty cents ($.80) per head on sheep and twenty cents
 8  ($0.20) fifty cents ($.50) per head on cattle. Each
 9  predatory animal district board shall annually determine
10  the predatory animal control fee to be charged and
11  collected in the district and shall inform the livestock
12  board of the fee prior to January 1 each year. The fee
13  shall not be collected on the same livestock more than once
14  in any twelve (12) month period. The livestock board may
15  retain not to exceed three percent (3%) of the revenues
16  collected for the cost of administering the program.
17  Remaining revenues collected by the livestock board under
18  this section shall be remitted to the state treasurer for
19  deposit in an account within the earmarked revenue fund.
20  The state treasurer, on a quarterly basis, shall distribute
21  the revenues to the county treasurer of the county from
22  which the shipment originated unless, at the time of
23  payment of the fees, the livestock owner designates the
24  fees to be distributed in total to another county in this

 1  state in which the livestock are fed or pastured. The
 2  county treasurer shall deposit revenues distributed under
 3  this subsection into a special continuing fund, to be known
 4  as the "Predatory Animal District Fund of .... County" and
 5  to be administered by the predatory animal board of that
 6  district.

 8         Section 2.  This act is effective July 1, 2001.
