Outfitters and guides-nonresident hunters.

A BILL

 

for

 

 1  AN ACT relating to outfitters and guides; eliminating
 2  required use of licensed professional guides by nonresident
 3  hunters when hunting in any designated wilderness area;
 4  eliminating reference to resident guides; providing for
 5  regulation by board of outfitters and professional guides
 6  if guides are used by nonresident hunters; and providing
 7  for an effective date.

 9  Be It Enacted by the Legislature of the State of Wyoming:

11         Section 1.  W.S. 23-2-401(a) is amended to read:

12 

13         23-2-401.  Nonresident hunters; use of licensed
14  professional guides; landowner guides.

 1         (a)  Except as provided under subsection (d) of this
 2  section, no A nonresident shall is not required to be
 3  accompanied by a licensed professional guide to hunt big or
 4  trophy game animals on any designated wilderness area, as
 5  defined by federal or state law, in this state. unless
 6  accompanied by a licensed professional guide or a resident
 7  guide. If a nonresident hunter elects to use the services
 8  of a licensed professional guide, there shall be at least
 9  one (1) licensed professional guide or resident guide
10  accompanying each two (2) nonresident hunters. The
11  commission may also specify other areas of the state, or
12  specific big or trophy game species, for which a licensed
13  professional or resident guide is required for
14  nonresidents, for purposes of proper game management,
15  protection of hunter welfare and safety, or better
16  enforcement of game fish laws. The commission Wyoming state
17  board of outfitters and professional guides may by rule and
18  regulation allow licensed professional guides to accompany
19  more than two (2) hunters but no more than six (6)
20  nonresident hunters in specific areas.

 2         Section 2.  This act is effective immediately upon
 3  completion of all acts necessary for a bill to become law
 4  as provided by Article 4, Section 8 of the Wyoming
 5  Constitution.
