Mining council membership.

A BILL

 

for

 

 1  AN ACT relating to mines and minerals; providing for
 2  membership on the state mining council as specified; and
 3  providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 30-2-301(a)(intro), (i) and (ii) is
 8  amended to read:

 9 

10         30-2-301.  Board of mines renamed mining council;
11  created; composition; qualifications, appointment and term
12  of members; removal; officers; rules; quorum; vacancies;
13  compensation.

15         (a)  There is created a state board of mines which is
16  renamed the state mining council within the department of

 1  employment which shall consist of eleven (11) members. Ten
 2  (10) members shall be appointed equally from among the
 3  management and hourly employees of the mining industry,
 4  including surface and underground coal mining, and shall
 5  serve for a term of four (4) years and until their
 6  successors are appointed and qualified except for the
 7  inspector who is a member of the council and entitled to
 8  vote in case of a tie. Each member of the council, except
 9  the inspector, shall be a qualified elector of the state
10  and shall have at least five (5) years experience in the
11  mining industry immediately preceding his appointment. The
12  members shall be appointed by the governor by and with the
13  advice and consent of the senate and from among the
14  management and employees of the mining industry. The tenure
15  of the members of the council shall be so arranged that the
16  terms of not more than five (5) of the members shall expire
17  in any one (1) year period. The governor may remove any
18  council member as provided in W.S. 9-1-202. The council
19  shall have among its appointed members:

21              (i)  An underground coal and gassy mine operator
22  or an underground coal and gassy mine operating management
23  official;

 1              (ii)  A practical underground coal and or gassy
 2  mine member; and

 3 

 4         Section 2.  This act is effective July 1, 2001.
