State lands-lease terms and purposes.

A BILL
for
1 AN ACT relating to state
lands; modifying the term and
2 purposes
of state land leases; authorizing reduced rental
3
fees for lands leased for affordable housing purposes;
4
granting rulemaking authority; and providing for an
5
effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:

36-5-114(a) and (c) is amended to
10 read:
11
12 36-5-114. Leasing for industrial,
commercial,
13 recreational, residential and affordable housing purposes;
14 authority; rental fees.

1 (a) The board
of land commissioners may lease, for a 2
term of not more than twenty-five
(25) years, with a
3 preferential
right to renew, for successive like periods, 4 state
lands for industrial, commercial,
and recreational,
5 residential and affordable housing purposes. The board
6 shall by rule and regulation establish criteria for
7 determining affordable housing under this section.

9 (c) Except as otherwise provided in this subsection,
10 the board
shall fix a rental value on the basis of a
11 definite amount per acre based upon not less
than fair
12 market value of each use of the land. If the land to be
13 leased is for
affordable housing purposes, the board may
14 fix a rental
value of less than fair market value. The
15 board shall by
rule and regulation establish criteria for
16 determining the
rental value of state lands leased for
17 affordable
housing purposes under this section. If the land
18 to be leased under this subsection was
originally acquired
19 by the state for the benefit of the common
school permanent
20 land fund, and is to be used by a Wyoming
school district
21 for the construction and maintenance of
school buildings
22 and facilities, the board may assess an
annual rental fee
23 of one hundred dollars ($100.00) per acre or
not less than
24 fair market value, whichever is less.

2 Section 2. This
act is effective immediately upon
3
completion of all acts necessary for a bill to become law
4 as
provided by Article 4, Section 8 of the Wyoming
5
Constitution.
