Contesting presidential elections.

A BILL
for
1 AN ACT relating to
presidential electors; limiting election
2 contests
of the office of president of the United States
3 and
Wyoming presidential electors as specified; specifying
4
that contests of presidential electors shall be resolved by
5 the
Wyoming legislature; and providing for an effective
6
date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 22-17-114 is created to read:
11
12 22-17-114. Contesting election of
president, vice-
13 president or presidential elector.
14
15 The election of a United States president
and vice-
16 president candidate, or presidential
elector, shall only be

contested, presented to and tried before the Wyoming
2
legislature under joint rules of the house of
3
representatives and senate. Such a contest may be initiated
4 by
a Wyoming elector by filing notice with the legislature
5
through the legislative service office no later than five
6 (5)
days after the election is certified by the state
7
canvassing board. The contest shall only be brought on the
8
grounds provided by W.S. 22-17-101(a)(i) or (iv). A
9
determination of the contest by the legislature is final
10 and conclusive and is not subject to
judicial review.

12 Section 2. W.S. 22-17-101(a)(intro)
and
13 22-17-102(a)(intro) are amended to
read:

15 22-17-101. Right to contest elections;
exception;
16 grounds.

18 (a) A qualified
elector may contest the right of a
19 person declared elected to an office in the
elector's
20 county, municipality, district or precinct,
other than the
21 office of state legislator, United States president and
22 vice-president
and presidential elector, on the following
23 grounds:

4 (a) Election
contests for all primary election
5
offices and all general election offices other than state
6
legislators, United States president and
vice-president and
7 presidential elector, may be commenced by the
contestant
8 filing
with the clerk of the district court of the county,
9 within
fourteen (14) days after the results of the election
10 have been certified by the canvassing board,
a verified
11 petition setting forth specifically:

13 Section 3. This act is effective July 1, 2001.
