Nuisance dogs.

A BILL

 

for

 

 1  AN ACT relating to barking or nuisance dogs; authorizing
 2  county commissioners to declare dogs as nuisances as
 3  specified; providing penalties for owners of dogs as
 4  specified; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 11-31-301(a), (b)(i), (c) and (g) is
 9  amended to read:

11         11-31-301.  Public nuisance; notice; penalties; rules
12  and regulations; animal control districts and officers.

13 

14         (a)  A board of county commissioners may declare the
15  running at large of any specified animals or dogs engaged
16  in continued or untimely barking or molesting passersby in

 1  unincorporated areas within the county limits a public
 2  nuisance.

 3 

 4         (b)  Notice of such a declaration shall be published
 5  in a newspaper of general circulation within the county and
 6  notices may be placed in appropriate locations. The notice
 7  shall specify any regulations necessary and convenient for
 8  animal control and shall state that:

 9 

10              (i)  It is a public nuisance for one (1) or more
11  specified animals to be running at large or for dogs to
12  engage in continued or untimely barking, or molest
13  passersby in unincorporated areas;

14 

15         (c)  Upon the filing of any complaint, the county
16  sheriff may arrest or issue a summons to the owner of any
17  animal which is running at large, has engaged in continued
18  or untimely barking, molested passersby or has attacked a
19  person. A first conviction is punishable by a fine of not
20  more than fifty dollars ($50.00). Each subsequent
21  conviction is punishable by a fine of not more than one
22  hundred dollars ($100.00).

 1         (g)  A board of county commissioners may enact
 2  regulations relative to dogs engaged in continued or
 3  untimely barking, dogs molesting passersby, dogs running at
 4  large, vicious dogs, dogs running wild game or livestock or
 5  acts by other animals which shall carry out the purposes of
 6  this section. The county sheriff shall and a county animal
 7  control officer or any other peace officer may enforce
 8  these regulations to protect persons and property.

10         Section 2.  This act is effective July 1, 2001.
