Retirement-reemployment of retiree.

A BILL

 

for

 

 1  AN ACT relating to state retirement; modifying conditions
 2  for reemployment of retired members as specified; and
 3  providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 9-3-415 by creating new subsections
 8  (g) through (j) is amended to read:

 9 

10         9-3-415.  When retirement permitted; service credit;
11  reemployment of retiree.

12 

13         (g)  Subject to subsection (h) of this section and in
14  accordance with rule and regulation of the board protecting
15  the actuarial integrity of the system and its status as a
16  federally qualified plan, any retired member rehired by a

 1  participating employer shall notify the board in writing of
 2  his election to:

 3 

 4              (i)  Discontinue retirement benefits and be
 5  reinstated as a contributing member; or

 6 

 7              (ii)  Continue receiving retirement benefits and
 8  not be reinstated as a contributing member.

 9 

10         (h)  Except as otherwise provided in this subsection,
11  if a retired member is rehired by a participating employer
12  on a permanent, full-time basis within six (6) months from
13  the date of payment of the first monthly retirement benefit
14  under the system following retirement, the member shall
15  immediately notify the board and request his benefit
16  payment be cancelled and that he be reinstated as a
17  contributing member. If within this six (6) month period
18  and following a break in service of at least thirty (30)
19  days, a retired member may continue to receive a retirement
20  benefit in accordance with paragraph (g)(ii) of this
21  section if he is:

23              (i)  Reemployed:

 1                   (A)  On a part-time basis for less than
 2  twenty (20) hours per week or for twenty (20) hours or more
 3  per week but not more than six (6) months in any
 4  consecutive twelve (12) month period; or

 5 

 6                   (B)  Only once on a full-time basis for not
 7  more than ten (10) consecutive months pursuant to a bona
 8  fide, documented employer emergency.

 9 

10              (ii)  Not employed on a permanent, full-time
11  basis by a participating employer within six (6) months
12  following termination of part-time or emergency
13  reemployment under paragraph (i) of this subsection.

14 

15         (j)  If any retired member violates subsection (h) of
16  this section, the board shall immediately cancel his
17  retirement benefit and shall reinstate that member as a
18  contributing member.

20         Section 2.  W.S. 9-3-415(c) is repealed.

 1         Section 3.  This act is effective immediately upon
 2  completion of all acts necessary for a bill to become law
 3  as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.
