Special event liquor permit.

A BILL
for
1 AN ACT relating to
alcoholic beverages; authorizing the
2
issuance of a special event liquor permit for rodeos
3 operated
by nongovernmental entities; specifying conditions
4 and
limitations; imposing annual fee requirement; and
5
providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 12-4-507 is created to read:
10
11 12-4-507. Special event liquor permit
for rodeos
12 operated by nongovernmental entities.
13
14 (a) Notwithstanding
any other provision of this title
15 and subject to subsection (d) of this
section, the
16 appropriate licensing authority may upon
application, issue
17 a special event liquor permit for the sale
of alcoholic and

malt beverages to the board of directors of a
2
nongovernmental entity operating a rodeo event within the
3
jurisdiction of the licensing authority. Restrictions
4
imposed under the retail liquor license population formula
5
pursuant to W.S. 12-4-201 shall not apply to a special
6
event liquor permit issued under this section. Any entity
7
licensed under this section shall not be issued and is not
8
eligible for a twenty-four (24) hour malt beverage permit
9 or
catering permit authorized under W.S. 12-4-502.

11 (b) The special
event liquor permit issued under
12 subsection (a) of this section shall not
authorize the sale
13 of alcoholic liquor or malt beverages for
consumption off
14 the premises owned or leased by the
permittee.
15
16 (c) The annual
fee for the special event liquor
17 permit authorized under this section shall
not exceed one
18 thousand five hundred dollars ($1,500.00),
payable in
19 advance.

21 (d) The local
licensing authority issuing the permit
22 shall by rule and regulation establish the
following
23 conditions and limitations for the special
event liquor
24 permit issued under this section which, to
the extent

applicable, are not less stringent than relevant
2
requirements and provisions of this title:

4 (i) The location of dispensing rooms;
5
6 (ii) The
furnishings and other features of the
7
dispensing rooms;
8
9 (iii) The
location of areas where alcoholic
10 liquor and malt beverages may be consumed on
the premises
11 owned or leased by the permittee;
12
13 (iv) The hours
and days of operation of the
14 dispensing room;
15
16 (v) A uniform
procedure of age identification
17 for employees working within the dispensing
rooms and for
18 all purchasers of alcoholic liquor and malt
beverages;
19
20 (vi) With the
exception of areas designated as
21 "sponsor and guest only" located
on the premises owned or
22 leased by the permittee, alcoholic liquor
and malt
23 beverages shall not be served as part of the
permittee's
24 daily operations;

2 (vii) Alcoholic
liquor and malt beverages shall

only be served in conjunction with the permittee's catered
4
events or sponsored special events;
5
6 (viii) If
alcoholic liquor and malt beverages
7 are
being served for a catered or sponsored special event
8
during the permittee's normal operating hours, the site,
9
area or property where the alcoholic liquor and malt
10 beverages are being served shall be
restricted from the
11 general public and the perimeter of the
event secured so
12 that alcoholic liquor and malt beverages are
not carried
13 into other areas or properties of the
permittee where
14 members of the general public who are not
participating in
15 the catered or special event are present;
16
17 (ix) Other rules
and regulations the licensing
18 authority determines necessary to carry out
this section.

20 Section 2. W.S. 12-4-502(c) is amended to read:
21
22 12-4-502. Twenty-four hour malt
beverage permit and
23 catering permit; restrictions; application procedure; fees.

1 (c) The permits
authorized by this section shall be
2
issued for one (1) twenty-four (24) hour period, subject to
3 the
schedule of operating hours provided by W.S. 12-5-101.
4 No
person or organization shall receive more than a total
5 of
twelve (12) malt beverage and catering permits for sales
6 at
the same premises in any one (1) year, except that this
7
limitation shall not be applicable to malt beverage permits
8
issued for sales at any fair, rodeo, pari-mutuel event or
9 other similar public event conducted by a public entity
10 upon public premises. No person or organization issued a
11 special event
liquor permit under W.S. 12-5-507 is eligible
12 to receive, nor
shall the licensing authority issue to such
13 person or
organization, a malt beverage and catering permit
14 under this
section.

16 Section 3. This act is effective July 1, 2001.
