A BILL

 

for

 

 1  AN ACT relating to the capitol police; transferring the
 2  capitol police to the highway patrol as specified;
 3  conforming provisions; specifying that all personnel,
 4  funding and equipment shall be transferred to the highway
 5  patrol; amending an incorrect reference as specified; and
 6  providing for an effective date.

 7 

 8  Be It Enacted by the Legislature of the State of Wyoming:

 9 

10         Section 1.  W.S. 6-1-104(a)(vi)(D), 7-2-101(a)(iv)(D)
11  and 24-12-102 are amended to read:

13         6-1-104.  Definitions.

14 

15         (a)  As used in W.S. 6-1-101 through 6-10-203 unless
16  otherwise defined:

 2              (vi)  "Peace officer" includes the following
 3  officers assigned to duty in the state of Wyoming:

 4 

 5                   (D)  Agents of the division of criminal
 6  investigation appointed pursuant to W.S. 9-1-613 and
 7  capitol police designated under W.S. 9-1-612 who have
 8  qualified pursuant to W.S. 9-1-701 through 9-1-707 9-1-708;

10         7-2-101.  Definitions.

11 

12         (a)  As used in W.S. 7-2-101 through 7-2-105:

13 

14              (iv)  "Peace officer" means:

15 

16                   (D)  Agents of the division of criminal
17  investigation appointed pursuant to W.S. 9-1-613 and
18  capitol police designated under W.S. 9-1-612 who have
19  qualified pursuant to W.S. 9-1-701 through 9-1-707 9-1-708;

20 

21         24-12-102.  Duties generally; emergencies.

22 

23         (a)  The state highway patrol, acting under the
24  direction of the director, shall enforce all the motor

 1  vehicle laws of this state. They shall also perform other
 2  duties assigned to them by the governor and are at all
 3  times subject to the call of the governor for emergency
 4  purposes at his discretion.

 5 

 6         (b)  The administrator of the state highway patrol
 7  shall provide state troopers for law enforcement services
 8  for state personnel and state property in Laramie county,
 9  Wyoming. Security for personnel in the capitol building,
10  governor's residence, other state buildings and security
11  which may require travel outside Laramie county shall be
12  provided as directed.

13 

14         Section 2.  W.S. 9-1-612(c) is repealed.

15 

16         Section 3.  All personnel, equipment and funding for
17  the capitol police within the division of criminal
18  investigation shall be transferred to the Wyoming highway
19  patrol, effective July 1, 2001.

20 

21         Section 4.  This act is effective July 1, 2001.
