Invalidity of same sex marriages.

A BILL

 

for

 

 1  AN ACT relating to domestic relations; creating an
 2  exception to the provision that all marriages validly
 3  contracted outside of this state are valid in Wyoming;
 4  providing that marriages between persons of the same sex
 5  are void; and providing for an effective date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 20-1-111 and 20-2-101(a) by creating
10  a new paragraph (iv) are amended to read:

11 

12         20-1-111.  Foreign marriages.

13 

14  All marriage contracts which are valid by the laws of the
15  state or country in which contracted are valid in this

 1  state, except marriages which are void under W.S.
 2  20-2-101(a)(iv).

 3 

 4         20-2-101.  Void and voidable marriages defined;
 5  annulments.

 6 

 7         (a)  Marriages contracted in Wyoming are void without
 8  any decree of divorce:

 9 

10              (iv)  When the persons are of the same sex.

11 

12         Section 2.  This act is effective July 1, 2001.
