End stage renal disease program.

A BILL

 

for

 

 1  AN ACT relating to the end stage renal dialysis program;
 2  authorizing an end stage renal dialysis program; requiring
 3  eligibility criteria; providing an appropriation; requiring
 4  rulemaking; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 42-4-117 is created to read:

 9 

10         42-4-117.  End stage renal dialysis program;
11  rulemaking; funding.

13         (a)  Effective July 1, 2001, the department shall
14  expand coverage for services authorized under W.S.
15  42-4-103(a)(xxiii) for qualified individuals in need of end
16  stage renal dialysis to the extent funding is available.

 2         (b)  The department shall by rule and regulation
 3  establish reasonable limits on services and supplies
 4  authorized under this section, including establishing
 5  eligibility criteria for receipt of services. In
 6  establishing eligibility criteria, the department shall
 7  consider financial ability of the individual or his family
 8  to contribute to the services, severity of the illness, the
 9  critical need for the services and the ability of the
10  program to meet the needs of the individual.

12         Section 2.  One million dollars ($1,000,000.00) is
13  appropriated to the department from the general fund to
14  implement the purposes of this act.

15 

16         Section 3.  This act is effective July 1, 2001.
