A BILL
for
1 AN ACT relating to
boards of cooperative educational
2 services;
modifying procedures for establishing boards as
3
specified; and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:
6
7 Section 1. W.S. 21-20-104 is amended to read:
8
9 21-20-104. Board of cooperative
educational services;
10 generally.
11
12 (a) If two (2)
or more boards of trustees desire to
13 establish a board of cooperative services
for the purpose
14 of providing cooperative educational
services and if the
15 services can be provided more effectively
through a
16 cooperative effort, the president of two (2) or more boards

1 of trustees may call a meeting of the interested boards. At
2 the meeting, the boards of trustees of the interested
3 districts, a majority of whose members
respectively vote in
4 favor
of doing so, may enter into an agreement to form a
5 board
of cooperative educational services. The agreement
6 shall
specify among other things the length of term of the
7 agreement,
the rights, responsibilities and obligations of
8 each
participating district, the types of services to be
9 rendered,
the procedure for the establishment of additional
10 services and the procedure for the inclusion
of additional
11 districts within the cooperative educational
services
12 program. The agreement shall also provide a
method for the
13 amendment and dissolution of the agreement
with the consent
14 of each participating district. Any
agreement to form a
15 board of cooperative educational services
entered into
16 between the participating districts shall be
approved by
17 the state board of education.

19 (b) The presidents of the boards of trustees agreeing
20 to participate in the board of cooperative
educational
21 services shall agree
upon and set a time and place of 22
meeting of the appoint members of the participating boards
23 of trustees for
the purpose of electing members of the to
a
24 board of cooperative educational services. At the meeting,

1 the participating boards of trustees may elect by secret 2
ballot from among the members of the
boards so assembled a 3
board of cooperative educational

4 board shall be composed of
not less than five (5) nor more
5 than
nine (9) members unless there are more than nine (9)
6 districts
participating in which event each participating
7 district
shall have one (1) member. Each participating
8 board
of trustees, regardless of its number of members,
is 9
entitled to cast five (5) votes in the selection of each of 10
the members of
the board of cooperative educational 11
services. Each
board of trustees party to the agreement
12 shall have at least one (1) member on appointed to
the
13 board of cooperative educational services.
The terms of
14 office of each of the members of the board
of cooperative
15 educational services shall be coterminous
with their
16 respective terms of office upon their boards
of trustees.
17 As the terms of office expire, or as
vacancies occur, new
18 members of the board of cooperative
educational services
19 shall be elected
appointed by the members board of
trustees
20 of the participating boards of trustees at a joint meeting 21
called for that
purpose district.
