Lobbyist reporting.

Case
A BILL
for
1 AN ACT relating to
lobbyists; providing for enforcement of
2
lobbyist reporting provisions by the secretary of state as
3
specified; providing rulemaking authority; specifying
4
lobbyist reporting requirements; and providing for an
5
effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 28-7-105 is created to read:
10
11 28-7-105. Enforcement by secretary of
state;
12 investigations; rules and regulations.
13
14 (a) The
secretary of state may conduct
15 investigations, inquiries and hearings
concerning the
16 provisions of this chapter.

2 (b) The
secretary of state shall accept for
3
investigation purposes from an individual, either
4
personally or on behalf of an organization or governmental
5
body, a complaint in writing stating the name of the person
6
alleged to have committed a violation of this chapter
7
setting forth the grounds for the complaint.
8
9 (c) If the
secretary of state determines that a
10 complaint filed under subsection (b) of this
section
11 alleges facts sufficient to constitute a
violation of this
12 chapter, the secretary of state shall
determine whether to
13 investigate, act upon the complaint or
certify his own acts
14 and records.
15
16 (d) The
secretary of state shall adopt and enforce
17 rules and regulations to implement the provisions
of this
18 chapter.

20 Section 2. W.S. 28-7-201(d)
and (e) is amended to
21 read:
22
23 28-7-201. Lobbyist activity reports;
contents, form
24 and filing requirements; penalties.

2 (d) Each lobbyist activity report shall contain:
3
4 (i) A listing of
the lobbyist's sources of
5
funding, each loan, gift, gratuity, special discount or
6
hospitality paid or given, as defined by rules and
7
regulations, to or on behalf of any legislator, state
8 elected
official or state employee acting in his official
9
capacity which exceeds fifty dollars ($50.00) in value
10 identified by date, amount and the name of
the legislator,
11 state elected official or state employee;.
12
13 (ii) The date, location, name of the legislative
14 body
invited and total expense incurred by each sponsoring
15 organization
for special events, including receptions,
16 meals,
entertainment, attendance at athletic events and
17 other
functions, to which members of the legislature, of
18 either
house of the legislature, of any committee of the
19 legislature
or any regional legislative delegation have
20 been
invited; and
21
22 (iii) A listing of total expenditures made by
23 the
lobbyist and the lobbyist's employer on lobbying
24 activities
including, but not limited to, salaries and

1 benefits, fees for professional and consulting services,
2 telephone, postage, printing, copies,
travel expenses,
3 meals, lodging, office equipment,
rent, staff support and
4 advertising in any medium.

6 (e) Special events, including receptions, meals, 7
entertainment, attendance at athletic
events and other 8
functions, to which members of the
legislature, of either 9
house of the legislature, of any
committee of the 10
legislature
or any regional legislative delegation have 11
been
invited shall be included in the report required under 12
this
section. The total expenses of activities reported
13 pursuant to this subsection
section shall be reported by
14 event or function not by individual
legislator. The report
15 shall specify the group of legislators
invited but is not
16 required to specify the names of individual
legislators.
17 Informational publications
and other printed materials used 18
for legislative
purposes are not reportable under this act.

20 Section 3. W.S. 28-7-201(g) and (k) is repealed.

22 Section 4. This act is effective July 1, 2001.
