Tobacco purchases-acceptable identification.

A BILL
for
1 AN ACT relating to
prevention of tobacco sales to minors;
2 specifying
what constitutes acceptable identification;
3
amending the affirmative defenses to the sale of tobacco
4
products to minors as specified; and providing for an
5
effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section
1. W.S. 14-3-302(f) and by creating a new
10 subsection (h) is amended to read:
11
12 14-3-302. Prohibited sales or delivery.
13
14 (f) It is an affirmative defense to a prosecution
15 under subsections (a) and (c) of this
section and a
16 petition for
injunction under subsection (e) of this
17 section
that, in the case of a sale, the person who sold

1 the tobacco product demanded, was presented with, and
2
reasonably relied upon, an identification card which:
3
4 (i) Identified
the person buying or receiving
5 the
tobacco product as being over eighteen (18) years of
6 age; and
7
8 (ii) Meets the
standards specified in subsection
9 (h) of this section.

11 (h) A motor vehicle driver's license, a registration
12 certificate
issued under the Federal Military Selective
13 Service
Act, an identification card issued to a member of
14 the
armed forces, an internationally accepted passport
15 document
with a discernible date of birth and photograph or
16 an
identification card issued by the department of revenue
17 is
prima facie evidence of the age and identity of a
18 person.

1 Section 2. This act is effective immediately upon

completion of all acts necessary for a bill to become law
3 as
provided by Article 4, Section 8 of the Wyoming
4
Constitution.
