Ethics act-amendments.

A BILL
for
1 AN ACT relating to
administration of government;
2
prohibiting certain participation in decisions in which the
3 official
has an interest as specified; and providing for an
4
effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section
1. W.S. 9-13-106(a)(intro), (ii) and (b) is
9
amended to read:
10
11 9-13-106. Official decisions and votes.
12
13 (a) A public
official, public member or public
14 employee shall not make an official decision
or vote on an
15 official decision or participate in the final vote or
16 decision or other
ancillary legislative, board or
17 commission
activity material to the bill's passage or the

1 decision to be voted upon if the public official,
public
2 member
or public employee has a personal or private
3 interest
in the matter. In determining whether he has a 4
personal or private interest in a matter The public
5 official
shall recognize the importance of his right to 6
represent his constituency and shall abstain from
voting
7 only in clear cases
of a personal or private interest as
8 defined
in this subsection. A public official, or public
9 member
shall not vote or public employee shall not take
10 part in the final
decision or other ancillary legislative,
11 board or
commission activity material to the decision to
12 give money or any direct financial benefit
to himself or
13 any family member
as defined by W.S. 9-13-102(a)(v) except
14 for tax reductions affecting the general
public. For the
15 purposes of this section, a personal or
private interest:
16
17 (ii) Is an
interest that provides the public
18 official, public employee or public member,
a greater
19 benefit or a lesser detriment than it does
for a large or
20 substantial group or class of persons who
are similarly
21 situated or any
person related to him who is listed in W.S.
22 9-13-102(a)(vi)(C)(I)
through (III) a direct or immediate
23 benefit.

1 (b) A public
official, public member or public
2
employee described by subsection (a) of this section shall
3 abstain
from voting on the decision and from making taking
4 part in any official decision in the matter. The
public
5 official's,
public member's or public employee's abstention
6 from
voting must be recorded in the governmental entity's
7 official
records.

9 Section 2. This act is effective July 1, 2001.
