Use of mobile communication while driving.

A BILL

 

for

 

 1  AN ACT relating to motor vehicles; prohibiting the use of
 2  cellular telephones and other mobile communication devices
 3  while driving; providing exceptions; providing definitions;
 4  providing penalties; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 31-5-235 is created to read:

 9 

10         31-5-235.  Use of cellular telephones and other mobile
11  communication devices.

12  

13         (a)  No person shall use a mobile communication device
14  while operating a motor vehicle unless the device is
15  specifically designed to allow hands-free operation and the
16  device is so used. This section shall not apply to a person
17  who is using the mobile communication device:

 2              (i)  To contact an emergency response vehicle; or

 3  

 4              (ii)  While the vehicle is lawfully parked.

 5  

 6         (b)  This section shall not apply to a person
 7  operating an emergency response vehicle while performing
 8  official duties.

 9  

10         (c)  Any person who operates a motor vehicle in
11  violation of this section shall be subject to the monetary
12  penalties provided by W.S. 31-5-1201(b).

14         (d)  As used in this section:

15  

16              (i)  "Emergency response vehicle" means any
17  ambulance, fire department, law enforcement, highway patrol
18  or civil defense vehicle or other vehicle used primarily
19  for emergency purposes;

20  

21              (ii)  "Mobile communication device" means a
22  cellular telephone, citizen's band radio or other device
23  that enables a person in a motor vehicle to transmit and

 1  receive audio signals to and from a person not in the motor
 2  vehicle.

 3  
 4            Section 2.  This act is effective July 1, 2001.
