A BILL
for
1 AN ACT relating to state
telecommunications; authorizing
2 the
department of administration and information to provide
3
telecommunications services to private health care
4
providers through the Wyoming equality network
5
infrastructure as specified; imposing duties on the
6
department of health; and providing for an effective date.
7
8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 9-2-1026.1
by creating a new
11 subsection (d), 21-2-202(a)(xx) and
37-15-104 by creating a
12 new subsection (b) are amended to
read:
13
14 9-2-1026.1. Duties performed through
information
15 technology division.

1 (d) In addition to
subsection (a) of this section,
2 the information technology division of
the department may,
3 through the infrastructure network
developed under the
4 statewide education technology plan in
accordance with W.S.
5 21-2-202(a)(xx), provide
telecommunications services to
6 private health care providers if
services are certified by
7 the department of health under this subsection. The
8 department of health shall:
9
10 (i) Determine health care services necessary for
11 the
effective and efficient operation of a tele-health
12 network
in the state;
13
14 (ii) Certify those services determined
15 necessary;
16
17 (iii) Notify the department of the services
18 certified
as necessary; and
19
20 (iv) Reimburse the department for costs incurred
21 for
the provision of telecommunications services under this
22 subsection
from funds available for this purpose, including
23 proportionate
overhead and administrative costs.

3 (a) In addition
to any other duties assigned by law,
4 the
state superintendent shall:
5
6 (xx) In
cooperation with the state board, the
7
Wyoming community college commission, University of
8
Wyoming, state telecommunications council, public service
9
commission, department of transportation, department of
10 administration and information, public
libraries, school
11 district boards of trustees, classroom
teachers and other
12 appropriate groups identified by the
superintendent,
13 develop and implement a statewide education
technology plan
14 which shall address staff training,
curriculum integration
15 and network connectivity in and between
schools,
16 communities and between the state and the
world, and which
17 shall have as its goal the provision of
equal access to
18 educational instruction and
information. The statewide
19 technology
education plan may include telecommunications
20 services provided
by the department of administration and
21 information
pursuant to W.S. 9-2-1026.1(d).
Not later than
22 January 10 of each year and with the
assistance of
23 participating agencies, an annual report on
the status of

1 the
statewide education technology plan shall be prepared
2 and
issued by the state superintendent;
3
4 37-15-104. Services not regulated by this title.
5
6 (b) In addition to
subsection (a) of this section,
7 telecommunications service does not
include, and the
8 provisions of this title do not apply
to telecommunications
9 services provided by the department of
administration and
10 information
to private health care providers under W.S.
11 9-2-1026.1(d).

13 Section 2. This act is effective July 1, 2001.
