A BILL
for
1 AN ACT relating to the
information technology oversight
2 panel;
increasing membership of the panel as specified;
3
providing for the sharing of information as specified;
4
limiting the sharing of information as specified; providing
5 for
the termination of an employee who discloses
6
information as specified; and providing for an effective
7
date.

9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 9-2-1018(c)
and by creating a new
12 subsection (g) is amended to read:
13
14 9-2-1018. Information technology division; powers
and
15 duties; information technology oversight panel.

1 (c) The
governor shall appoint the director of the
2
department of administration and information and two (2) 3 four (4) additional directors of state departments
or
4 separate
operating agencies to act as a an information
5 technology
oversight panel. The panel shall oversee the
6 implementation
of this section as directed by the governor.

8 (g) Notwithstanding
any other provision of state law,
9 the information technology oversight
panel may authorize,
10 unless
otherwise restricted by federal law or regulation,
11 the
exchange of information between state agencies, which
12 is
classified as confidential or private, for the purpose
13 of
improving services to citizens or the effectiveness and
14 efficiency
of the operation of state government. The
15 authorization
of information exchange shall be made through
16 written
request of a state agency needing the information.
17 The
written request shall include a description of the
18 information
to be exchanged, the security provisions for
19 protecting
the information and the benefit to be derived
20 from
the exchange. In addition, where the exchange of
21 information
will result in a substantial additional cost to
22 the
agency providing the data or required by a federal cost
23 accounting
provision, the agency obtaining the information
24 shall
be responsible for reimbursement of the costs. The

1 information technology oversight panel before approving a
2 request shall obtain the
recommendation of the agency whose
3 information is being requested, with
regards to the
4 exchange of the information, and shall
determine the
5 potential for damage to any affected
citizen or business if
6 the information is inadvertently
released. The state agency
7 receiving the information shall adhere
to the
8 confidentiality and privacy standards
of the state agency
9 providing the information and to any
state laws governing
10 the
information. With respect to any information shared
11 under
this subsection:
12
13 (i) Any employee who knowingly discloses
14 information
in violation of state law may be terminated
15 without
utilizing any progressive discipline procedures
16 otherwise
required under the state personnel rules;
17
18 (ii) The information technology oversight panel
19 may
revoke the approval of the exchange of data at any time
20 if
the panel determines the receiving agency is not
21 adequately
protecting private or confidential information
22 or
adhering to the confidentiality and privacy standards of
23 the
agency providing the information.
