Billboard reductions.

A BILL
for
1 AN ACT relating to
outdoor advertising; providing for the
2
reduction in size of billboards as specified; conforming
3 provisions;
providing for the dismantling and removal of
4
noncompliant billboards as specified; repealing the
5
requirement for payment of compensation; and providing for
6 an
effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 24-10-106(a), (b)(intro) and by
11 creating a new subsection (m), 24-10-107(b)
and
12 24-10-109(a)(iii) and by creating a
new paragraph (iv) are
13 amended to read:
14
15 24-10-106. Size,
lighting and spacing; where signs

may be erected.

1 (a) Except as otherwise provided in this section, the
2
minimum standards and criteria for the size, lighting and
3
spacing of outdoor advertising, and the criteria for
4
unzoned commercial or industrial zones or areas within the
5
controlled area along the interstate and primary systems
6
designated in W.S. 24-10-104 shall conform to those
7
promulgated and submitted by the secretary of
8
transportation to the congress of the United States on or
9
about January 10, 1967.

11 (b) No sign
face within the state of Wyoming, erected
12 and
permitted under W.S. 24-10-107(b) prior to April 1,
13 2001,
shall exceed the following limits:
14
15 (m) No sign face within the state of Wyoming,
16 permitted
under W.S. 24-10-107(b) and erected on or after
17 April
1, 2001, shall exceed one hundred fifty (150) square
18 feet.
Any sign face exceeding one hundred fifty (150)
19 square
feet and permitted prior to April 1, 2001, shall be
20 reduced
in size to comply with the limitations in this
21 section
no later than January 1, 2010, or the sign shall
22 otherwise
be dismantled and removed. No compensation shall
23 be
paid for any sign that is dismantled and removed to be
24 in
compliance with this section.

2 24-10-107. Permits and identification tags.

4 (b) Permits
shall be for three (3) years, shall be
5
assigned a permit number, and shall be renewed annually
6
thereafter upon payment of five dollars ($5.00) without the
7
filing of a new application. On or after
April 1, 2001, new
8 permits shall only be issued for outdoor advertising signs,
9 displays or devices that do not exceed a sign face of one
10 hundred fifty
(150) square feet. All fees shall be paid
11 into the state highway fund. All such fees
collected shall
12 be used by the commission for relocation or
damages, but
13 not for administrative purposes.

15 24-10-109. What outdoor advertising
deemed unlawful;
16 procedure for removal.

18 (a) The
following outdoor advertising is deemed
19 unlawful:
20
21 (iii) When a
permittee fails to comply with a
22 notice
of violation as provided in W.S. 24-10-108;. or

1 (iv) Effective January
1, 2010, signs, displays
2 and devices exceeding the size limits
specified in W.S.
3 24-10-106(m) shall not be allowed and
such signs, displays
4 and devices shall be dismantled and
removed no later than
5 January 31, 2010.

7 Section 2. W.S. 16-8-101 is repealed.

9 Section 3. This act is effective immediately upon
10 completion of all acts necessary for a bill
to become law
11 as provided by Article 4, Section 8 of the
Wyoming
12 Constitution.
