Pari-mutuel wagering-amendments.

A BILL
for
1 AN ACT relating to pari-mutuel
wagering; modifying the
2
requirement for stewards as specified; creating a special
3 purse
account; depositing a portion of simulcast wagering
4
revenues into the account; specifying distribution of
5
account revenues; imposing additional requirements upon
6
simulcast permittees; increasing breeder award fund
7
contributions; and providing for an effective date.
8
9 Be It Enacted by the Legislature of the State of Wyoming:
10
11 Section 1. W.S. 11-25-102(a)(vii)(A)
and by creating
12 a new paragraph (xi), 11-25-104(g)(intro)
and 11-25-105(b)
13 by creating a new paragraph (iii),
(c), (d) and (j) are
14 amended to read:

1 (a) As used in this act:
2
3 (vii) "Simulcasting"
means the sale of
4
pari-mutuel pools on interstate or intrastate televised
5
pari-mutuel events as prescribed by the commission. The
6
commission shall authorize simulcasting subject to the
7
following conditions:
8
9 (A) Simulcasting
may be conducted only by a
10 holder of a permit to simulcast issued under
this act. The
11 permit shall be authorized annually by the
commission for a
12 specified number of days. The commissioners
shall issue a
13 simulcast permit only to an applicant
authorized under this
14 act to conduct a pari-mutuel event other
than simulcasting
15 and the applicant
or one (1) or more applicants holds at
16 least twenty-two
(22) days of live horse racing events per
17 year;
18
19 (xi) "Gross handle" means the total amount
20 wagered.

2 (g) The
commission may delegate authority to enforce
3
rules of the commission and this act to three (3) stewards
4 at
each pari-mutuel event, at least one (1) of whom shall
5 be
an employee of and selected by the commission. The
6
commission shall may require at least one (1) steward to
7
supervise each simulcast location that is approved by the
8
commission. Stewards shall exercise such reasonable
and
9
necessary authority as is designated
by rules of the
10 commission including the following:
11
12 11-25-105. Pari-mutuel permits; fees
and reports;
13 disposition of funds; enforcement of provisions.
14
15 (b) Every
Wednesday following any pari-mutuel event,
16 the permittee shall:
17
18 (iii) Pay an amount equal to three percent (3%)
19 of
the gross handle from the amount retained under
20 subsection
(c) of this section to the commission to be
21 credited
by the state treasurer to a special purse account
22 within
the earmarked revenue fund in the manner specified
23 under
subsection (d) of this section.

1 (c) The
permittee may retain an amount equal to
2
nineteen and four-tenths percent (19.40%) of the total
3
amount wagered shown by the report and may retain up to an
4
additional five percent (5%) of the amount wagered on
5
multiple or exotic wagers. The permittee shall retain the
6
breakage on not more than ten cents ($.10) and retain
7
unclaimed tickets not claimed within one (1) year following
8 the
event for the expenses of the race meet and purses and
9 for
the promotion of the racing industry. Of the amount
10 retained under
this subsection, the permittee shall pay
11 three percent
(3%) of the gross handle to the commission as
12 provided under
paragraph (b)(iii) of this section.

14 (d) All sums
paid to the commission under this act
15 except contributions from permittees to the
breeder award
16 fund, fines and penalties and payments by permittees to the
17 special purse
account within the earmarked revenue fund,
18 shall be credited to the pari-mutuel account
within the
19 earmarked revenue fund which shall be used
by the
20 commission for the payment of all expenses
incurred in
21 enforcing this act. All fines and penalties
assessed under
22 this act shall be credited to the county
public school
23 fund. Amounts
deposited into the special purse account
24 created under
paragraph (b)(iii) of this section shall be

1 distributed by the state treasurer to all permittees
2 holding at least one (1) live pari-mutuel
event during the
3 preceding calendar year based upon the
number of race days
4 and the number of races held during
that year. Permittees
5 receiving distributions from the
special purse account
6 under this subsection shall add not
less than eight percent
7 (8%) of the total amount wagered at
each live event to
8 purses offered by the permittee at
that event. The state
9 treasurer
shall pay out of the pari-mutuel account
all
10 warrants drawn by the state auditor, upon
vouchers issued
11 and signed by the president, vice-president
or executive
12 secretary of the commission. The commission
shall keep an
13 accurate and true account of all funds
received and all
14 vouchers issued by the commission. All funds
received and
15 all vouchers issued by the commission shall
be audited at
16 least biennially by the director of the state
department of
17 audit or his designee and a copy of the
audit shall be
18 delivered within thirty (30) days after
completion to the
19 governor and the commission. The costs of
the audit shall
20 be borne by the commission. The members of
the commission
21 shall receive statutory per diem expenses
and mileage as
22 allowed state employees, and compensation of
fifty dollars
23 ($50.00) for each day during which they are
actually
24 engaged in the discharge of their duties.
The total

expenses incurred by the commission shall not exceed the
2
total amount in the pari-mutuel account.

4 (j) As a
condition of receiving a pari-mutuel permit,
5 the
permittee shall agree to and shall contribute to the
6 breeder
award fund administered by the commission an amount
7
equal to four-tenths of one percent (0.40%) five-tenths of
8 one percent (0.50%) of the total handle wagered
during the
9 pari-mutuel
event and an additional sum equal to twenty
10 percent (20%) of the additional amount
retained pursuant to
11 subsection (c) of this section on multiple
or exotic
12 wagers. The contribution shall be derived
from the net
13 proceeds of the race meet revenues, other
than the
14 permittee's share of the pari-mutuel
wagering handle.
15 Contributions shall be used only for breeder
awards.

17 Section 2. This act is effective July 1, 2001.
