2002 Olympics Commission.

A BILL

 

for

 

 1  AN ACT relating to promoting the 2002 Winter Olympic games;
 2  creating a Wyoming Winter Olympic games commission;
 3  requiring the commission to develop a comprehensive plan to
 4  promote the 2002 Winter Olympic games, to report the plan
 5  to the governor and legislature; authorizing the commission
 6  to accept assistance, monies and assets, designating uses
 7  thereof; enumerating powers and duties of the commission;
 8  authorizing the commission to employ a director and staff
 9  and specifying duties and conditions of employment;
10  providing an appropriation; terminating the commission
11  effective July 1, 2002 and providing for an effective date.

13  Be It Enacted by the Legislature of the State of Wyoming:

14 

15         Section 1.  W.S. 9-2-2601 through 9-2-2606 are created
16  to read:

 2         2002 WYOMING OLYMPIC WINTER GAMES COMMISSION

 3 

 4         9-2-2601.  Commission created; appointment; membership;
 5  salary; meetings; termination.

 6 

 7         (a)  The 2002 Wyoming Winter Olympic games commission
 8  is created for purposes of promoting the 2002 Winter
 9  Olympic games.

10 

11         (b)  The commission shall be composed of two (2)
12  senators, appointed by the senate president; two (2)
13  representatives, appointed by the speaker of the house;
14  three (3) representatives of tourism; three (3) Wyoming
15  residents appointed at large. The three (3) representatives
16  of tourism and the three (3) Wyoming residents shall be
17  appointed by the governor.

19         (c)  Appointed commission members shall serve until
20  completion of duties delegated to the commission under this
21  article and completion of the final report on Wyoming's
22  promotions and activities conducted in promoting the Winter
23  Olympic games pursuant to W.S. 9-2-2606. If a vacancy

 1  occurs, the appropriate appointing person shall appoint a
 2  new member pursuant to subsection (b) of this section.

 3 

 4         (d)  Appointed members of the commission shall receive
 5  the per diem paid members of the Wyoming legislature for
 6  each day of actual service and when engaged in necessary
 7  travel plus necessary expenses.

 8 

 9         (e)  The members shall elect one (1) member to serve as
10  chairman.

11 

12         (f)  The commission shall meet at the call of the
13  chairman or at the call of a majority of the commission
14  members. Six (6) members constitute a quorum.

15 

16         (g)  Effective July 1, 2002, the Wyoming Winter Olympic
17  games commission shall terminate.

18 

19         9-2-2602.  Director; appointment; duties; additional
20  staff; qualifications.

21 

22         (a)  The governor with consent of the commission, shall
23  appoint a director who shall serve at the pleasure of the
24  commission. The director shall:

 2              (i)  Serve as administrative head of the
 3  commission staff;

 4 

 5              (ii)  Perform duties prescribed by the commission
 6  and assist the commission in carrying out duties imposed
 7  under this article; and

 8 

 9              (iii)  Not be subject to W.S. 9-2-1019 through
10  9-2-1022 and 9-3-101 through 9-3-104 but shall receive
11  compensation and be reimbursed for travel and other
12  necessary expenses as prescribed by the commission and
13  approved by the governor.

15         (b)  Subject to approval of the commission, the
16  director shall employ one (1) staff member to assist the
17  commission in performing its duties. One (1) staff member
18  shall possess those administrative, technical, professional
19  and clerical qualifications determined necessary by the
20  commission. All staff to the commission shall serve at the
21  pleasure of the director.

23         9-2-2603.  Comprehensive state plan; composition;
24  report to legislature.

 2         (a)  The commission shall develop a comprehensive state
 3  plan for activities and projects to encourage and promote
 4  attendance at the 2002 Winter Olympic games. The plan shall
 5  provide for:

 6 

 7              (i)  The promotion of Winter Olympic games
 8  attendance; and

 9 

10              (ii)  The promotion of economic development
11  connected with the 2002 Winter Olympic games.

12 

13         (b)  The comprehensive plan for Wyoming to promote
14  economic development in conjunction with promoting the
15  Winter Olympic games and tourism shall be reported to the
16  legislature by or before July 1, 2001. In developing the
17  plan, the commission shall:

19              (i)  Disseminate to the general public not later
20  than July 1, 2001, a proposed state plan including those
21  areas specified under subsection (a) of this section; and

22 

23              (ii)  Consult with citizens, private organizations
24  and state and local government.

 2         9-2-2604.  Additional powers and duties of commission;
 3  appointment of advisory committees.

 4 

 5         (a)  In addition to other duties imposed under this
 6  article, the commission shall:

 7 

 8              (i)  Gather and disseminate to the general public
 9  information pertaining to the 2002 Winter Olympic games;

10 

11              (iii)  Encourage persons residing outside of
12  Wyoming to attend the Winter Olympic games and to also
13  visit Wyoming; and

14 

15         (b)  The commission may appoint advisory committees it
16  considers necessary to assist the commission and its staff
17  in performing duties imposed under this article. Services
18  rendered by advisory committee members shall be voluntary
19  and shall not be compensated.

21         9-2-2605.  Donations; deposit and expenditure of
22  monies; financial assistance to local entities.

 1         (a)  The commission may receive assistance, assets and
 2  monies donated, contributed or allotted by any federal
 3  agency, private organization, individual or from any other
 4  source. The monies and the proceeds from the sale of any
 5  assets shall be used in the administration of this article
 6  and the provision of any Olympic related promotion or
 7  activity under the authority of the commission.

 8 

 9         (b)  All monies received by the commission from sources
10  enumerated under subsection (a) of this section shall be
11  deposited with the state treasurer in an account within the
12  appropriate fund. Subject to legislative approval, monies
13  within the account shall be administered and expended by
14  the commission to carry out duties and the purposes of this
15  article and to provide financial assistance to local
16  nonprofit corporations and local government in accordance
17  with subsection (c) of this section. Monies and proceeds
18  from the sale of assets donated, contributed or allotted
19  for a particular or special purpose shall be expended or
20  otherwise made available only in accordance with the
21  purpose for which received.

23         (c)  Upon application or a determination by the
24  commission, the commission may provide financial assistance

 1  to any local nonprofit corporation or local government for
 2  planning or organizing a Winter Olympic games related
 3  event. Financial assistance provided under this subsection
 4  shall be restricted to those activities, projects and
 5  events complying with standards developed under the state
 6  comprehensive plan and sanctioned by the commission.

 7 

 8         9-2-2606.  Report on Olympic activities.

 9 

10  The commission shall prepare a final report describing the
11  promotions and activities. The report shall be submitted to
12  the governor and the legislature not later than July 1,
13  2002.

14 

15         Section 2.  Five hundred thousand dollars ($500,000.00)
16  will be appropriated from the general fund to the
17  commission to fund the 2002 Wyoming Winter Olympic games
18  commission for the purposes if implementing this act.

 1         Section 3.  This act is effective immediately upon
 2  completion of all acts necessary for a bill to become law
 3  as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.
