Criminal conspiracy.

A BILL

 

for

 

 1  AN ACT relating to criminal conspiracy; clarifying when
 2  criminal conspiracy occurs as specified; and providing for
 3  an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 7-1-109(g)(ii), 7-3-605(a)(intro),
 8  7-19-301(a)(xiii), 26-14-111(a), 31-5-1202, 35-7-1042,
 9  35-7-1059(a)(iv) and 42-2-112(a) and (b) are amended to
10  read:

12         7-1-109.  Examination for sexually transmitted
13  diseases required in certain cases; health officers to
14  notify crime victims; results confidential.

16         (g)  As used in this section:

 1              (ii)  "Sex offense" means sexual assault under
 2  W.S. 6-2-302 through 6-2-305 6-2-304, attempted sexual
 3  assault, conspiracy, as defined in W.S. 6-1-303(a), to
 4  commit sexual assault, incest under W.S. 6-4-402 or
 5  indecent liberties under W.S. 14-3-105.

 6 

 7         7-3-605.  Authorization for interception of wire, oral
 8  or electronic communications.

 9 

10         (a)  The governor, the attorney general or the
11  district attorney within whose jurisdiction the order is
12  sought in conjunction with the attorney general, may
13  authorize an application to a judge of competent
14  jurisdiction for an order authorizing the interception of
15  wire, oral or electronic communications by the Wyoming
16  division of criminal investigation or any law enforcement
17  agency of the state having responsibility for investigation
18  of the offense for which the application is made, if the
19  interception may provide evidence of an attempt to commit,
20  conspiracy, as defined in W.S. 6-1-303(a), to commit,
21  solicitation to commit or the commission of any of the
22  following felony offenses or comparable crimes in any other
23  jurisdiction:

 1         7-19-301.  Definitions.

 2 

 3         (a)  For purposes of this act:

 4 

 5              (xiii)  "Sex offense" means the offenses of
 6  sexual assault under W.S. 6-2-304(a)(i) or 6-2-304(a)(iii)
 7  if the victim is sixteen (16) years of age or older,
 8  conspiracy, as defined in W.S. 6-1-303(a), to commit sexual
 9  assault as defined by W.S. 6-2-301(a)(v), indecent
10  liberties under W.S. 14-3-105 provided the victim was at
11  least sixteen (16) and less than eighteen (18) years of age
12  and the offender was at least four (4) years older than the
13  victim, or an attempt to commit an offense enumerated in
14  this paragraph. "Sex offense" includes an offense committed
15  in another jurisdiction, including a federal court or
16  courts martial, which, if committed in this state, would
17  constitute a "sex offense" as defined in this paragraph;

19         26-14-111.  Insurers and advisory organizations;
20  monopolies prohibited; agreements to adhere prohibited.

21 

22         (a)  No insurer or advisory organization shall attempt
23  to monopolize or combine or conspire, with any other person

 1  as defined in W.S. 6-1-303(a), to monopolize an insurance
 2  market in this state.

 3 

 4         31-5-1202.  Parties to crime.

 5 

 6  Every person who commits, attempts to commit, conspires, as
 7  defined in W.S. 6-1-303(a), to commit, or aids or abets in
 8  the commission of, any act declared herein in this chapter
 9  to be a crime, whether individually or in connection with
10  one (1) or more other persons or as a principal, agent or
11  accessory, is guilty of the offense, and every person who
12  falsely, fraudulently, forcibly or willfully induces,
13  causes, coerces, requires, permits or directs another to
14  violate any provision of this act is likewise guilty of the
15  offense.

17         35-7-1042.  Attempts and conspiracies.

18 

19  Any person who attempts or conspires, as defined in W.S.
20  6-1-303(a), to commit any offense under this article within
21  the state of Wyoming or who conspires, as defined in W.S.
22  6-1-303(a), to commit an act beyond the state of Wyoming
23  which if done in this state would be an offense punishable
24  under this article, shall be punished by imprisonment or

 1  fine or both which may not exceed the maximum punishment
 2  prescribed for the offense the commission of which was the
 3  object of the attempt or conspiracy.

 4 

 5         35-7-1059.  Unlawful clandestine laboratory
 6  operations; penalties.

 7 

 8         (a)  It is unlawful for any person to knowingly or
 9  intentionally:

10 

11              (iv)  Conspire, with as defined in W.S.
12  6-1-303(a), or aid another to engage in a clandestine
13  laboratory operation.

14 

15         42-2-112.  Misrepresentation; penalties; recovery,
16  termination or modification of assistance and services.

17 

18         (a)  No person shall knowingly make a false statement
19  or misrepresentation, fail to disclose a material fact,
20  aid, abet or conspire, with any other personas defined in
21  W.S. 6-1-303(a), in obtaining any form of food stamp
22  benefit under the food stamp program.

 1         (b)  No person shall knowingly make a false statement
 2  or misrepresentation, fail to disclose a material fact,
 3  aid, abet or conspire, with any other personas defined in
 4  W.S. 6-1-303(a), in obtaining any commodity under the food
 5  stamp program.

 7         Section 2.  This act is effective July 1, 2001.
