Unclaimed Utility Deposit Act.

A BILL

 

for

 

 1  AN ACT relating to unclaimed property; providing for
 2  disposal of unclaimed utility deposits; subsidizing low
 3  income energy costs; conforming related provisions; and
 4  providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 34-24-201 through 34-24-204 are
 9  created to read:

11                         ARTICLE 2

12              UNCLAIMED UTILITY DEPOSIT ACT

13 

14         34-24-201.  Short title.

15 

16  This act shall be known as and may be cited as the
17  "Unclaimed Utility Deposit Act."

 2         34-24-202.  Definitions.

 3 

 4         (a)  As used in this act:

 5 

 6              (i)  "Low income energy assistance program" means
 7  as defined by W.S. 42-2-115;

 8 

 9              (ii)  "Utility" means a person who owns or
10  operates for public use any plant, equipment, property,
11  franchise or license for the transmission of
12  communications, including cable television or the
13  production, storage, transmission, sale, delivery or
14  furnishing of electricity, water, steam or gas;

15 

16              (iii)  "This act" means W.S. 34-24-201 through
17  34-24-204.

19         34-24-203.  Deposits held by utilities.

20 

21  A deposit, including any interest thereon, made by a
22  subscriber with a utility to secure payment or any sum paid
23  in advance for utility services to be furnished, less any
24  lawful deductions, that remains unclaimed by the owner for

 1  more than one (1) year after termination of the services
 2  for which the deposit or advance payment was made is deemed
 3  abandoned.

 4 

 5         34-24-204.  Disposal of monies.

 6 

 7  Any deposit determined to be abandoned pursuant to W.S.
 8  34-24-203 shall be transferred to the department of family
 9  services by the utility not less than once a year. The
10  department of family services shall place the monies into a
11  low income energy assistance program pursuant to W.S.
12  44-2-115 and disperse the monies according to the
13  provisions of that act.

15         Section 2.  W.S. 34-24-109 is amended to read:

16 

17         34-24-109.  Deposits held by utilities.

18 

19  A deposit, including any interest thereon, made by a
20  subscriber with a utility to secure payment or any sum paid
21  in advance for utility services to be furnished, less any
22  lawful deductions, that remains unclaimed by the owner for
23  more than one (1) year after termination of the services
24  for which the deposit or advance payment was made is deemed

 1  abandoned not considered abandoned for purposes of this act
 2  but will be considered abandoned for purposes of the
 3  Unclaimed Utility Deposit Act.

 4 

 5         Section 3.  This act is effective July 1, 2001.
