Health insurance coverage for childhood immunizations.

A BILL
for
1 AN ACT relating to
insurance coverage; mandating coverage
2 for
childhood immunizations under health insurance policies
3 as
specified; providing for applicability of the section;
4
realigning the chapter as specified;
and providing for an
5
effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section 1. W.S. 26-20-201 is created to read:
10
11 ARTICLE 2
12 CHILDHOOD IMMUNIZATIONS COVERAGE
13
14 26-20-201. Childhood immunizations coverage required.
15
16 (a) All
individual and group health insurance
17 policies providing coverage on an expense
incurred basis,

1 and
individual and group service or indemnity type
2
contracts issued by any insurer including any nonprofit
3
corporation which provide coverage shall also provide
4
coverage for all routine and necessary immunizations for
5
children under such policy, contract or plan delivered or
6
renewed on and after July 1, 2001. The required benefits
7
under this section shall apply to immunizations
8
administered to each child from birth to eighteen (18)
9
years of age.

11 (b) The
benefits required under this section shall
12 not be subject to any deductible, copayment,
coinsurance or
13 other dollar limit provision in the policy
or plan.
14
15 (c) This
section shall apply to all individual and
16 group health insurance policies delivered or
issued on or
17 after July 1, 2001. The provisions of this
section shall
18 not apply to short-term travel,
accident-only, workers'
19 compensation insurance coverage, limited or
specified
20 disease policies or contracts designed for
issuance to
21 persons eligible for coverage under Title
XVIII of the
22 Social Security Act, or any other similar
coverage under
23 state or federal governmental plans, or to
short-term

nonrenewable policies of not more than six (6) months
2
duration.

4 (d) For
purposes of this section, "routine and
5
necessary immunizations" means immunizations against
6
diphtheria, tetanus, pertussis, hepatitis B, haemophilus
7
influenzae type b, polio, measles, mumps, rubella,
8
varicella, hepatitis A, pneumococcal and any other
9
immunizations universally recommended by the advisory
10 committee on immunization practices (ACIP),
the American
11 academy of pediatrics (AAP) and the American
academy of
12 family physicians (AAFP).

14 Section 2. W.S. 26-20-104 is amended to read:

1 The
requirements of this chapter article regarding newly
2
born children apply to all insurance policies and
3
subscriber contracts delivered or issued for delivery in
4
this state more than one hundred twenty (120) days after
5 May
30, 1975. The requirements of this chapter article
6
regarding adopted children apply to all insurance policies
7 and
subscriber contracts delivered or issued for delivery
8 in
this state after June 8, 1989.

10 Section 3. This act is effective July 1, 2001.
