Comparative fault-amendments.

A BILL

 

for

 

 1  AN ACT relating to comparative fault; providing that the
 2  definition of fault for purposes of comparative fault does
 3  not include intentional acts or omissions; and providing
 4  for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 1-1-109(a)(iv) is amended to read:

 9 

10         1-1-109.  Comparative fault.

11 

12         (a)  As used in this section:

13 

14              (iv)  "Fault" includes acts or omissions, except
15  intentional acts or omissions, determined to be a proximate
16  cause of death or injury to person or property, that are in
17  any measure negligent, or that subject an actor to strict

 1  tort or strict products liability, and includes breach of
 2  warranty, assumption of risk and misuse or alteration of a
 3  product;

 4 

 5         Section 2.  This act is effective July 1, 2001.
