University of Wyoming police department-mutual aid.

A BILL

 

for

 

 1  AN ACT relating to University of Wyoming police;
 2  authorizing mutual aid agreements between University of
 3  Wyoming police and certain other entities; specifying
 4  responsibility for worker's compensation, salary and
 5  equipment damage coverage; and providing for an effective
 6  date.

 7 

 8  Be It Enacted by the Legislature of the State of Wyoming:

 9 

10         Section 1.  W.S. 7-2-106(b) and  by creating new
11  subsections (c) and (d) is amended to read:

12 

13         7-2-106.  Requests for temporary assignment of peace
14  officers; extraterritorial authority of peace officers;
15  liability; compensation.

 1         (b)  A peace officer designated in subsection (a) or
 2  (c) of this section who makes an arrest or issues a
 3  citation pursuant to this section outside his own
 4  jurisdiction shall be deemed to be acting within the scope
 5  of his duties for purposes of the Wyoming Governmental
 6  Claims Act and the state self-insurance program, W.S.
 7  1-41-101 through 1-41-111. All privileges and immunities
 8  from liability, and all pension, disability, worker's
 9  compensation and other benefits which normally apply to
10  peace officers while they perform their duties in their own
11  jurisdiction shall also apply to them when acting as
12  provided in subsection (a) or (c) of this section. For
13  purposes of W.S. 27-14-104, the requesting and assigning
14  law enforcement agencies under subsection (a) of this
15  section shall be a joint employer as defined under W.S.
16  27-14-102(a)(xix) and the designated peace officer shall be
17  a joint employee as defined under W.S. 27-14-102(a)(xxi).
18  The cost of salary and benefits accruing to a peace
19  officer, while performing duties at the request of another
20  law enforcement jurisdiction under subsection (a) of this
21  section, shall be borne by the individual peace officer's
22  own employing agency. The cost of any damage to equipment
23  belonging to the officer or his employer occurring while

 1  acting under the provisions of this section shall be borne
 2  by the requesting law enforcement agency.

 3 

 4         (c)  The chief of police of the University of Wyoming,
 5  the chief of police of the city of Laramie and the sheriff
 6  of Albany county may enter into a mutual aid agreement
 7  between or among any or all of them regarding the
 8  assignment of peace officers upon terms and conditions
 9  satisfactory to them, subject to rules and procedures
10  established by the governing body of the university, city
11  and county, respectively. Direction and control of peace
12  officers while performing duties under a mutual aid
13  agreement established pursuant to this subsection shall be
14  specified in the agreement. Peace officers performing
15  duties under a mutual aid agreement established pursuant to
16  this subsection shall have the authority of a peace officer
17  within the territorial jurisdiction of the parties to the
18  agreement to the extent provided in the agreement.

20         (d)  For purposes of worker's compensation under W.S.
21  27-14-104, the peace officer remains the employee of his
22  agency and is not a joint employee when the peace officer
23  is acting under a mutual aid agreement established under
24  subsection (c) of this section. The cost of salary and

 1  benefits accruing to a peace officer, and the cost of
 2  damage incurred to equipment owned by a peace officer or
 3  his employing agency while performing duties under a mutual
 4  aid agreement established under subsection (c) of this
 5  section shall be borne by the peace officer's own employing
 6  agency or the peace officer, if the equipment is owned by
 7  the peace officer.

 9         Section 2.  This act is effective July 1, 2001.
