Privileged communications.

A BILL

 

for

 

 1  AN ACT relating to privileged communications and acts;
 2  authorizing exceptions in certain circumstances; and
 3  providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 1-12-101(a)(i) is amended to read:

 8 

 9         1-12-101.  Privileged communications and acts.

10 

11         (a)  The following persons shall not testify in
12  certain respects:

13 

14              (i)  An attorney or a physician concerning a
15  communication made to him by his client or patient in that
16  relation, or his advice to his client or patient. The
17  attorney or physician may testify by express consent of the

 1  client or patient, and if the client or patient voluntarily
 2  testifies the attorney or physician may be compelled to
 3  testify on the same subject. A physician may also express
 4  his opinion regarding issues placed into contest by his
 5  patient, which may include disclosing information about the
 6  physical and psychological conditions of the patient, to
 7  counsel for the parties to such contest in either a formal
 8  proceeding or an informal, ex parte meeting;

 9 

10         Section 2.  This act is effective July 1, 2001.
