Penitentiary construction.

A BILL
for
1 AN ACT relating to
administration of government; providing
2 an
appropriation for the design, plan, construction and
3
operation of a prison; specifying applicability of existing
4
provisions relating to the state contracting for private
5
correctional facilities; and providing for an effective
6
date.

8 Be It Enacted by the Legislature of the State of Wyoming:

12 (a) Prior to
June 1, 2001, the department of
13 administration and information shall develop
a request for
14 proposals for plans, design, construction
and operation of
15 a state prison. The request for proposals
shall be
16 submitted to the state building commission
for approval.

1 The
state building commission shall submit the approved

request for competitive bids. The request for proposals,
3 any
subsequent contract and other actions by the state
4
pursuant to this act shall be in accordance with the
5
following:

7 (i) The
contract, construction, lease, if any,
8
operation, maintenance, purchase or management of
9
facilities and services provided shall be compatible with
10 the provisions of W.S. 7-22-101 through 7-22-114,
except as
11 otherwise provided in this act;
12
13 (ii) Standards
for prequalification of
14 applicants shall be developed by the state
building
15 commission, but need not be promulgated as
rules. W.S.
16 7-22-102(f) shall not be applicable;
17
18 (iii) The
state building commission shall act on
19 behalf of the state, and may delegate any
duties under this
20 act to an appropriate agency of the state;
21
22 (iv) Any of the
activities specified in
23 paragraph (i) of this subsection may be
undertaken by the
24 state or through contract with a private
entity.

2 Section 2. Forty-five million dollars
3 ($45,000,000.00)
is appropriated from the general fund to
4 the
department of administration and information to be
5
expended as necessary by the state building commission for
6
purposes of this act.

8 Section 3. This act is effective immediately upon
9
completion of all acts necessary for a bill to become law
10 as provided by Article 4, Section 8 of the
Wyoming
11 Constitution.
