A BILL

 

for

 

 1  AN ACT relating to professions and occupations;
 2  establishing the animal euthanasia certification board as
 3  specified; authorizing the board to certify animal
 4  euthanasia technicians; specifying eligibility criteria;
 5  specifying approved training and testing; granting
 6  rulemaking authority; providing definitions; and providing
 7  for an appropriation; and providing for an effective date.

 8 

 9  Be It Enacted by the Legislature of the State of Wyoming:

10 

11         Section 1.  W.S. 33-30-216 through 33-30-219 are
12  created to read:

13 

14         33-30-216.  Definitions.

15 

16         (a)  As used in this act:

 1              (i)  "Board" means the Wyoming animal euthanasia
 2  technician board;

 3 

 4              (ii)  "Certified animal euthanasia technician"
 5  means a person who is employed or sponsored by a law
 6  enforcement agency whose duties include the euthanasia of
 7  unwanted, sick, injured or dangerous animals. A certified
 8  animal euthanasia technician shall be registered with the
 9  Wyoming board of veterinary medicine to purchase, possess
10  and administer euthanasia drugs and chemical restraint
11  drugs as defined by this act. A certified animal euthanasia
12  technician shall successfully complete a board approved
13  training and testing program and be certified in the
14  following:

15 

16                   (A)  Methods of humanely euthanizing
17  injured, sick, homeless or unwanted animals;

18 

19                   (B)  Security precautions;

20 

21                   (C)  Record keeping; and

22 

23                   (D)  Other skills as determined necessary by
24  the board.

 2              (iii)  "Chemical restraint" means the use of
 3  drugs to tranquilize, sedate or immobilize animals for
 4  euthanasia or capture. These drugs include acetylpromazine,
 5  xylazine, ketamine, tiletamine and zolezepam;

 6 

 7              (iv)  "Euthanasia" means the act or practice of
 8  providing a humane death for animals;

 9 

10              (v)  "Euthanasia drugs" means any pentobarbital
11  based drug labeled by the manufacturer for the purpose of
12  euthanasia of animals;

13 

14              (vi)  "This act" means W.S. 33-30-216 through
15  33-30-218.

16 

17         33-30-217.  Animal euthanasia technician certification
18  board created, composition, duties, rulemaking,
19  qualifications, terms of office.

20 

21         (a)  There is created an animal euthanasia technician
22  certification board to certify animal euthanasia
23  technicians. The board shall consist of five (5) members
24  appointed by the governor upon the recommendation of the

 1  Wyoming state board of veterinary medicine. The membership
 2  of the board shall include at least one (1) licensed
 3  veterinarian, one (1) actively employed animal control
 4  officer and one (1) law enforcement official whose duties
 5  include supervision of animal control. After the initial
 6  term of the members, applicants to the board shall be
 7  certified euthanasia technicians, a veterinarian licensed
 8  in this state or a certified peace officer.

 9 

10         (b)  Members of the board shall serve a term of three
11  (3) years. The initial board shall have staggered terms of
12  one (1), two (2) and three (3) years.

13 

14         (c)  The board shall examine and approve available
15  training and testing programs.

16 

17         (d)  The board shall examine the credentials of every
18  applicant for a certified animal euthanasia technician and
19  may issue certification on the bases of the successful
20  completion of an approved program. All examinees shall
21  provide proof of the completion of an approved program. The
22  board may require oral interviews and practical
23  demonstrations.

 1         (e)  A criminal history background check on applicants
 2  will be required pursuant to W.S. 7-19-106(a)(ix).

 3 

 4         (f)  The board shall promulgate rules and regulations
 5  relating to professional conduct which establish ethical
 6  and professional standards of practice and for other
 7  purposes in accordance with the Wyoming Administrative
 8  Procedure Act.

 9 

10         (g)  The board shall conduct investigation and
11  hearings pursuant to the Wyoming Administrative Procedure
12  Act.

13 

14         33-30-218.  Certified animal euthanasia technicians,
15  eligibility, surrender or revocation of certificate.

16 

17         (a)  Any person applying for a certification as an
18  animal euthanasia technician shall be employed or sponsored
19  by a law enforcement agency. An applicant shall make a
20  written application to the board. The application shall be
21  accompanied by:

 1              (i)  A fee in the amount established pursuant to
 2  rules and regulations not to exceed one hundred dollars
 3  ($100.00); and

 4 

 5              (ii)  Proof that the applicant:

 6 

 7                   (A)  Is of good moral character;

 8 

 9                   (B)  Is a citizen of the United States or is
10  lawfully admitted to remain and work in the United States;

11 

12                   (C)  Is employed or sponsored by a law
13  enforcement agency;

14 

15                   (D)  Has not been convicted of a felony or
16  misdemeanor cruelty to animal or animal neglect; and

17 

18                   (E)  Any other information required by the
19  board.

20 

21         (b)  The certification issued pursuant to this section
22  shall be for a two (2) year period unless surrendered by
23  the certified animal euthanasia or revoked or suspended by
24  the board for cause. The certified animal euthanasia shall

 1  renew the certificate every two (2) years. Application for
 2  renewal shall be accompanied by:

 3 

 4              (i)  The established fee;

 5 

 6              (ii)  Proof of current employment or sponsorship
 7  by a law enforcement agency; and

 8 

 9              (iii)  Proof of a minimum of eight (8) hours of
10  approved training.

11 

12         (c)  Nothing in this act shall apply to veterinarians
13  licensed pursuant to W.S. 33-30-101 et seq.

14 

15         (d)  The fees received under subsection (a) or (b) of
16  this section shall be deposited with the state treasury who
17  shall credit the money to an account within the special
18  revenue fund. All monies paid into the state treasury and
19  credited to the account are appropriated to the use of the
20  animal euthanasia technician certification board to be used
21  to defray costs and expenses incurred in the administration
22  of this act.

24         33-30-119.  Compensation of board members.

 2  Board members shall receive no compensation for their
 3  services but shall receive per diem for travel expenses in
 4  accordance with W.S. 9-3-102.

 5 

 6         Section 2.  W.S. 7-19-106(a) by creating a new
 7  paragraph (ix) and 33-30-204(m) by creating a new paragraph
 8  (ix) are amended to read:

 9 

10         7-19-106.  Access to, and dissemination of,
11  information.

12 

13         (a)  Criminal history record information shall be
14  disseminated by criminal justice agencies in this state,
15  whether directly or through any intermediary, only to:

16 

17              (ix)  The Wyoming animal euthanasia technicians
18  board for purposes of obtaining background information on
19  applicants for certification under the board.

20 

21         33-30-204.  Board of veterinary medicine.

22 

23         (m)  The board is empowered to:

 1              (xiv)  Register certified animal euthanasia
 2  technicians pursuant to W.S. 33-30-216(a)(vi).

 3 

 4         Section 3.  There is appropriated from the general
 5  fund ten thousand dollars ($10,000.00) to the Wyoming
 6  animal euthanasia technician board for the purposes of this
 7  act.

 8 

 9         Section 4.  This act is effective July 1, 2001.
