State lands-surface damage payments-3.

A BILL
for
1 AN ACT relating to state
lands; requiring that revenues
2
generated from commercial users of state lands be paid to
3
public schools; specifying that a grazing lessee shall be
4
entitled to either reimbursement for forage loss or have an
5
appropriate reduction of animal unit months; and providing
6 for
an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 36-5-118 is created to read:
11
12 36-5-118. Payment for damaged lands.
13
14 (a) The office
of state lands and investments shall
15 negotiate a payment from a third party for
any damage to
16 the surface of any leased state lands
resulting from the
17 entry upon the leased state lands by the
third party. The

payment shall be consistent with any payment made for
2
damages to adjacent lands. Any payment shall be made
3
payable to the office of state lands and investments. The
4
office of state lands and investments shall redistribute
5
amounts pursuant to subsection (b) of this section. After
6
approval by the director, the office of state lands and
7
investments shall deposit remaining money collected into
8 the
public school foundation program account established
9
under W.S. 21-13-306.

11 (b) Upon proof
through documentation and a sworn
12 statement that the value of the leased land
has been
13 reduced by entry of a third party, a grazing
lessee shall
14 be entitled to either reimbursement for
forage loss or have
15 the rental fee which he pays reduced
accordingly.

17 (c) The
following persons shall not be considered
18 third parties subject to the requirements of
this section:
19
20 (i) Members of
the board of state lands and
21 investments or its representative when
entering state lands
22 for the purposes of management or
administration of the
23 state lands; and

1 (ii) Members of
the public when entering for

purposes of recreation.

4 Section 2. W.S. 36-5-114 by creating new subsections
5
(d) and (e) is amended to read:
6
7 36-5-114. Leasing for industrial,
commercial and
8 recreational purposes;
authority; rental fees.
9
10 (d) When the board leases land for commercial
11 purposes
pursuant to this section, revenues generated shall
12 be
deposited into the public school foundation program
13 account
established under W.S. 21-13-306.
14
15 (e) For purposes of this section "commercial purpose"
16 means
for the purpose of economic gain.
17
18 Section 3. This act is effective July 1, 2001.
