Child health insurance program amendments.

A BILL
for
1 AN ACT relating to the
child health insurance program;
2 eliminating
the child health insurance voucher program;
3
expanding coverage under the child health insurance program
4 as
specified; conforming provisions; and providing for an
5
effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section
1. W.S. 35-25-101(a)(ii), 35-25-103(a)(i) and
10 by creating a new subsection (g) and
35-25-110(a)(i) are
11 amended to read:
12
13 35-25-101. Uninsured child health insurance program.
14
15 (a) There is
created a child health insurance program
16 for families with:

1 (ii) Maximum
gross monthly income at or below
2 one hundred fifty percent (150%) two hundred percent (200%)
3 of
the federal poverty level.

5 35-25-103. Child health insurance
program
6 description, eligibility
and duties.
7
8 (a) Subject to
approval of the state plan by the
9
United States secretary of health and human services, the
10 department shall provide:
11
12 (i) Medical
assistance, including those services
13 authorized under the Wyoming Medical
Assistance and
14 Services Act, to an eligible child under
this act whose
15 gross family income is at or below one hundred thirty-three 16
percent (133%) two hundred percent (200%) of the federal
17 poverty level;
18
19 (g) The department may contract for all or part of
20 the
administration of the program provided by this article.
21 The
department may require contractors to provide an
22 implementation
and management plan.

4 (a) The department shall not implement:

6 (i) The program
under this act until a state
7
plan including the provision of services similar to the
8
Wyoming Medical Assistance and Services Act and
use of 9
vouchers as provided by this act has been
approved by the
10 United States secretary of health and human
services except
11 that the department may implement a partial
state plan
12 implementing W.S. 35-25-109 and any portion
of the state
13 plan for which the United States secretary
of health and
14 human services may give approval; and
15
16 Section 2. W.S. 35-25-103(a)(ii) and (e)(vii),
17 35-25-104, 35-25-106 and 35-25-107 are
repealed.

19 Section 3. This act is
effective immediately upon
20 completion of all acts necessary for a bill
to become law
21 as provided by Article 4, Section 8 of the
Wyoming
22 Constitution.
