Teachers-performance based pay plan.

 1  AN ACT relating to teachers; providing for a performance-
 2  based compensation plan as specified; providing procedures
 3  for approval of a plan; providing for an evaluation of the
 4  plan; providing duties of the Wyoming department of
 5  education; providing an appropriation; and providing for an
 6  effective date.

 7 

 8  Be It Enacted by the Legislature of the State of Wyoming:

 9 

10         Section 1.  W.S. 21-7-601 and 21-7-602 are created to
11  read:

13                         ARTICLE 7

14              PERFORMANCE-BASED COMPENSATION PLAN

 1         21-7-601.  Performance-based compensation plan;
 2  development; requirements; submission; evaluation.

 3 

 4         (a)  A school district may implement a three (3) year
 5  performance-based compensation plan.  Before a school
 6  district may implement a plan, the district shall review
 7  all of the model performance-based compensation plans
 8  compiled and distributed by the Wyoming department of
 9  education under W.S. 21-7-602. The school district may
10  select one (1) of the model performance-based compensation
11  plans provided or may select parts of the model plans or
12  may develop innovative plans of their own.

14         (b)  As part of the process of developing its
15  performance-based compensation plan, the school district
16  shall hold at least one (1) public hearing on the proposed
17  plan other than the hearing at which the plan is adopted.
18  At the hearing the district shall take testimony from all
19  interested persons, including parents, students, teachers,
20  administrators and members of the community. Before final
21  adoption of the plan, the school board shall submit the
22  proposed plan to the Wyoming department of education for
23  review and comment, and the department shall provide its

 1  written comments to the school board not later than thirty
 2  (30) days after the plan is submitted to the department.

 3 

 4         (c)  The department shall approve a plan only if the
 5  benefits under the plan are limited to be paid to certified
 6  teachers who actually teach students in a classroom or to
 7  certified teachers who assume additional professional
 8  responsibilities related to the classroom.

10         (d)  At a minimum, a performance-based compensation
11  plan shall provide:

12 

13              (i)  An incentive be paid to a teacher for:

14 

15                   (A)  Obtaining certification from the
16  National Board of Professional Teaching Standards; and

17 

18                   (B)  The improved performance of students,
19  taught by the teacher, on the Wyoming Content and
20  Performance Standards;

21 

22              (ii)  Provide strategies for teacher recruitment
23  and retention;

 1              (iii)  Provide a professional development program
 2  designed to assist teachers in attaining higher competency
 3  standards; and

 4 

 5              (iv)  A methodology for evaluating the
 6  effectiveness of the plan in terms of improved student
 7  performance and teacher satisfaction with the plan. The
 8  evaluation methodology used shall be based upon a research
 9  design that is accepted widely in the post-secondary
10  education community and shall include review by peers and
11  administrators. Not later than November 1, 2003, the school
12  board shall submit a written evaluation of its plan as
13  provided in this paragraph to the department, the
14  legislature and the governor.

16         (e)  A performance-based compensation plan shall be
17  adopted by a school board only on a majority vote of the
18  school board on the record. Upon final adoption of the
19  plan, the school board shall submit the plan to the Wyoming
20  department of education. The department shall approve or
21  disapprove, in writing, the plan not later than thirty (30)
22  days after the plan is received.

 2         (a)  No later than August 1, 2001, the Wyoming
 3  department of education shall:

 4 

 5              (i)  Compile performance-based compensation plans
 6  that meet academically accepted research standards; and

 7 

 8              (ii)  Based upon the plans compiled, develop
 9  guidance for school boards in the design of performance-
10  based compensation plans including a report of the current
11  research and practice and a recommended set of performance-
12  based compensation plans.

13 

14         (b)  No later than August 15, 2001, the department
15  shall disseminate to each school board, the legislature and
16  the governor the report it produces pursuant to subsection
17  (a) of this section.

19         Section 2.  For the fiscal year beginning July 1, 2001
20  and ending June 30, 2002, there is appropriated from the
21  general fund to the school foundation program twenty
22  million dollars ($20,000,000.00) to fund the three (3) year
23  performance-based compensation plans adopted by school
24  boards and approved by the Wyoming department of education

 1  pursuant to W.S. 21-7-601. Each school board whose
 2 
performance-based compensation plan is approved by the
 3  Wyoming department of education pursuant to W.S. 21-13-601
 4  shall receive from the
school foundation program an amount
 5  which is the product of multiplying the appropriation by
 6  the proportion the average daily membership (ADM) of the
 7  district, where the kindergarten ADM for the district is
 8  divided by two (2), is to the total statewide ADM for the
 9  fiscal year
beginning July 1, 2000 and ending June 30,
10  2001
.

12         Section 3.  This act is effective July 1, 2001.
