A BILL

 1  AN ACT relating to peace officers; clarifying game and fish
 2  enforcement personnel peace officer authority as specified;
 3  and providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7        Section 1.  W.S. 6-1-104(a)(vi)(C) and
 8  7-2-101(a)(iv)(C) are amended to read:

 9 

10        6-1-104.  Definitions.

11 

12        (a)  As used in W.S. 6-1-101 through 6-10-203 unless
13  otherwise defined:

15            (vi)  "Peace officer" includes the following
16  officers assigned to duty in the state of Wyoming:

 2                 (C)  Game and fish law enforcement personnel
 3  qualified pursuant to W.S. 7-2-101 9-1-701 through 9-1-707
 4  and:

 5 

 6                      (I)  When enforcing Wyoming felony
 7  statutes following observation or discovery of the
 8  commission of a felony, which was observed or discovered
 9  during the performance of their statutory duties;, or

10 

11                      (II)  While responding to requests to
12  assist other peace officers performing their official
13  duties or when enforcing a valid arrest warrant for any
14  crime; or

15 

16                      (III)  When enforcing any provision of
17  title 23 and chapter 13 of title 41, any rule and
18  regulation promulgated by the Wyoming game and fish
19  commission or any other statute for which they are granted
20  statutory enforcement authority.

22        7-2-101.  Definitions.

24        (a)  As used in W.S. 7-2-101 through 7-2-105:

 2            (iv)  "Peace officer" means:

 4                 (C)  Game and fish law enforcement personnel
 5  qualified pursuant to W.S. 9-1-701 through 9-1-707 and:

 6 

 7                      (I)  When enforcing Wyoming felony
 8  statutes following observation or discovery of the
 9  commission of a felony, which was observed or discovered
10  during the performance of their statutory duties;, or

11 

12                      (II)  While responding to requests to
13  assist other peace officers performing their official
14  duties or when enforcing a valid arrest warrant for any
15  crime; or

16 

17                      (III)  When enforcing any provision of
18  title 23 and chapter 13 of title 41, any rule and
19  regulation promulgated by the Wyoming game and fish

 1        Section 2.  This act is effective immediately upon
 2  completion of all acts necessary for a bill to become law
 3  as provided by Article 4, Section 8 of the Wyoming
 4  Constitution.
