Game damage licenses.

A BILL
for
1 AN ACT relating to game
and fish; modifying game damage
2
awards to landowners by authorizing the issuance of hunting
3 licenses
instead of monetary payments; specifying procedure
4 and
delegating rulemaking authority; and providing for an
5
effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:

9 Section
1. W.S.
23-1-901 by creating a new subsection
10 (g) is amended to read:
11
12 23-1-901. Owner of damaged property to
report damage;
13 claims for damages; time for filing; determination; appeal;
14 arbitration; issuance of hunting licenses instead of
15 payment.

1 (g) Instead of payment
for the amount of verified
2 damages under subsection (c) of this
section, the claimant
3 may request payment be made by the
issuance of hunting
4 licenses as authorized under this
subsection. A request
5 for additional hunting licenses shall
be made to the
6 department at the time the verified
claim for damages is
7 submitted under subsection (b) of this
section. Upon
8 receipt and after investigation of the
claim pursuant to
9 subsection (c) of this section, the
department shall submit
10 the
request to the commission. Following review of the
11 request
and claim, and subject to conditions imposed upon
12 claimants
for damage awards under subsection (c) of this
13 section,
the commission may award hunting licenses for
14 antelope,
deer and elk to the claimant as payment for
15 verified
damages under this section instead of awarding a
16 payment
for the amount of verified damages. The award shall
17 require
the claimant to notify the department of the name
18 of
the individual to be attached to each awarded license
19 and
the big game species for which each license is to be
20 issued. Each license issued by the department under
this
21 subsection
shall be valid for the hunt area of the big game
22 species
in which the major portion of the lands affected by
23 the
game damage are located. The department shall by rule
24 and
regulation establish a schedule specifying the number

1 of licenses awarded under this section in relation to the
2 total dollar amount of verified
damages involved in the
3 claim, differentiated by big game
species. In no case shall
4 the total number of hunting licenses
for all big game
5 species issued to any one (1) claimant
during any one (1)
6 hunting season exceed four (4).
Licenses issued under this
7 subsection shall be in addition to
limitations imposed by
8 the commission under W.S. 23-1-703 and
hunting licenses
9 issued to the claimant under W.S. 23-2-101.
By requesting
10 hunting
licenses in lieu of game damage payments pursuant
11 to
this subsection, the claimant waives any right to
12 arbitration
or appeal under subsections (d) and (e) of this
13 section.

15 Section 2. This act is effective July 1, 2001.
