A BILL

 

for

 

 1  AN ACT relating to crimes and offenses; modifying
 2  aggravating circumstance for death penalty purposes; and
 3  providing for an effective date.

 4 

 5  Be It Enacted by the Legislature of the State of Wyoming:

 6 

 7         Section 1.  W.S. 6-2-102(h)(viii) is amended to read:

 8 

 9         6-2-102.  Presentence hearing for murder in the first
10  degree; mitigating and aggravating circumstances; effect of
11  error in hearing.

13         (h)  Aggravating circumstances are limited to the
14  following:

 1              (viii)  The murder of a judicial officer, former
 2  judicial officer, district attorney, former district
 3  attorney, defending attorney, peace officer, juror or
 4  witness, during or because of the exercise of his official
 5  duty or because of the victim's former or present official
 6  status;

 7 

 8         Section 2.  This act is effective immediately upon
 9  completion of all acts necessary for a bill to become law
10  as provided by Article 4, Section 8 of the Wyoming
11  Constitution.
