Mental Health Professions Practice Act-exemptions.

A BILL
for
1 AN ACT relating to the
Mental Health Professions Practice
2 Act;
providing exemptions to the act as specified; limiting
3 the
services that are exempted as specified; and providing
4 for
an effective date.

6 Be It Enacted by the Legislature of the State of Wyoming:
7
8 Section
1. W.S. 33-38-103(a) by creating a new
9
paragraph (viii) is amended to read:
10
11 33-38-103. Exemptions.
12
13 (a) Nothing in
this act shall be construed to apply
14 to the activities and services of:
15

1 (viii) A person who is
employed by or under
2 contract with the departments of
corrections or family
3 services or by the county jail who
provides services to
4 offenders under the supervision or in
the custody of the
5 respective department related to the
offender's supervision
6 and management as directed by the
department if the person
7 providing the services is not licensed
or certified as, and
8 does not represent himself to be, a
professional counselor,
9 clinical social worker, marriage and
family therapist or
10 addiction
therapist, certified social worker, certified
11 addictions
practitioner or certified mental health worker
12 and
the person is providing any of the following services:
13
14 (A) Facilitation, leadership or instruction
15 in
educational programs addressing criminal behaviors or
16 life
skills;
17
18 (B) Advising or directing an offender
19 regarding
behavioral issues, required conduct and
20 programmatic
requirements as related to the offender's
21 supervision
or custody;
22
23 (C) Nonclinical services that are provided
24 to
assist the offender in gaining access to needed medical,

1 social, educational and other services, assist the offender
2 in making arrangements necessary to
move from a residential
3 or institutional placement to the
community, or foster the
4 offender's rehabilitation by
organizing needed services and
5 supports. Such services include
prerelease planning,
6 linkage, monitoring and follow-up,
referral, advocacy and
7 crisis intervention.

9 Section 2. This act is effective immediately upon
10 completion of all acts necessary for a bill
to become law
11 as provided by Article 4, Section 8 of the
Wyoming
12 Constitution.
