A BILL
for
1 AN ACT relating to
medication aides and assistants;
2
authorizing medication aides and assistants to perform
3 duties
as specified; providing definitions; granting rule
4
making authority to the board of nursing as specified; and
5
providing for an effective date.

7 Be It Enacted by the Legislature of the State of Wyoming:
8
9 Section
1. W.S. 33-21-120(a) by creating new
10 paragraphs (xii) and (xiii) and by
renumbering (xii) as
11 (xiv) and 33-21-122(c) by creating
new paragraphs (xxiv)
12 and (xxv) are amended to read:
13
14 33-21-120. Definitions.

16 (a) As used in this act:

2 (xii) "Medication
aides" means certified nursing
3 assistants/nurse aides who have met
the additional
4 educational and certification
standards established by the
5 board of nursing to perform the
nursing function of
6 medication administration under the
direction or
7 supervision, as defined by the board,
of a registered
8 nurse;
9
10 (xiii) "Medication assistant" means unlicensed
11 assistive
personnel who have met the educational standards
12 established
by the board of nursing to perform the nursing
13 function
of medication administration under the direction,
14 as
defined by the board, of a registered nurse;
15
16 (xii)(xiv) "This
act" means W.S. 33-21-119
17 through 33-21-156.

19 33-21-122. Board of nursing; powers and duties.

21 (c) Without
limiting the foregoing, the board of
22 nursing may do the following:

24 (xxiv) By board rule and regulation, prescribe:

2 (A) Uniform and
reasonable standards for
3 medication administration;
4
5 (B) Educational
standards applicable to
6 medication aides and assistants;
7
8 (C) Qualifications,
certification,
9 recertification, examination,
practice, continuing
10 competencies
and discipline of medication aides.

12 (xxv) Set a fee for certification,
13 recertification
or examination of medication aides or
14 assistants.

16 Section 2. This act is effective July 1, 2001.
