Retention election of circuit judges.

A BILL

 

for

 

 1  AN ACT relating to retention election of circuit judges;
 2  clarifying the electorate for retention election of circuit
 3  judges; revising which magistrates are subject to a
 4  retention vote; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 22-2-105(a)(ii) is amended to read:

 9 

10         22-2-105.  Terms of office and offices voted on at
11  general elections.

13         (a)  The terms of office and offices voted on at
14  general elections are as follows:

15 

16              (ii)  Four Year Term. -At the general election
17  in 1974 and in every fourth (4th) year thereafter, there

 1  shall be elected the following officers: one (1) governor,
 2  one (1) secretary of state, one (1) state treasurer, one
 3  (1) state auditor, one (1) superintendent of public
 4  instruction, county clerks, county treasurers, county
 5  assessors, county coroners, county and prosecuting
 6  attorneys, district attorneys, sheriffs, clerks of the
 7  district court and justices of the peace. In those counties
 8  that have established a circuit court, the question of
 9  retention of a circuit court judge or a magistrate of the
10  circuit court for the unexpired balance of or a new four
11  (4) year term shall be submitted to the electorate of the
12  circuit for a circuit court judge and to the electorate of
13  the county for a magistrate, as necessary. At every general
14  election there shall be elected the necessary member or
15  members of the Wyoming senate and county commissioners.; In
16  those counties that have established a circuit court, the
17  question of retention of a circuit court judge or a
18  magistrate of the circuit court shall be submitted:

20                   (A)  For a circuit court judge, to the
21  electorate of all counties within the circuit except for
22  any county which is not a part of the circuit court system;

 1                   (B)  For a magistrate required by law to
 2  stand for retention, to the electorate of the county
 3  wherein the magistrate serves.

 4 

 5         Section 2.  This act is effective July 1, 2001.
