 3  projects; specifying terms and conditions of funding for
 4  projects; providing restrictions relating to sales of water
 5  and operation of projects; providing appropriations;
 6  modifying project descriptions, terms of appropriations for
 7  various specified prior projects; and providing for an
 8  effective date.

10              [2001 NEW DEVELOPMENT PROJECTS]

12       99-3-503.  Level III construction projects – new
13  development.

14 

15       (a)  Authorization is granted for the Level III new
16  development construction projects identified in this
17  section, subject to the general conditions specified in
18  W.S. 99-3-103.

19 

20       (b)  Project - Oakley Water Supply Project:

21 

22              (i)  Project sponsor: Oakley Improvement and
23  Service District;

 1              (ii)  Project purpose: Rural and domestic water
 2  supply;

 3 

 4              (iii)  Project description: A water supply
 5  pipeline valves, and appurtenances necessary to make the
 6  project function in the manner intended;

 7 

 8              (iv)  Total project budget: Three hundred fifty-
 9  two thousand dollars ($352,000.00);

10 

11              (v)  Project grant: The state of Wyoming shall
12  grant to the sponsor from water development account I
13  through the commission for the design, permit procurement,
14  project land procurement, construction engineering, and
15  construction of the project an amount not to exceed one
16  hundred seventy-six thousand dollars ($176,000.00) or fifty
17  percent (50%) of the actual development costs, whichever is
18  less;

20              (vi)  Appropriation: There is appropriated from
21  water development account I to the commission one hundred
22  seventy-six thousand dollars ($176,000.00) or as much
23  thereof as is necessary to carry out the purpose of this
24  subsection. Unexpended funds appropriated under this

 1  subsection shall revert to water development account I on
 2  July 1, 2005; and

 3 

 4              (vii)  Special conditions:

 5 

 6                   (A)  The sponsor is responsible for
 7  acquiring fifty percent (50%) of the total project budget
 8  from other sources;

10                   (B)  The project is expressly contingent on
11  formation of the Oakley Improvement and Service District
12  and approval of a project financing plan by an election
13  held pursuant to the Improvement and Service District Act,
14  W.S. 18-12-101 through 18-12-140, and the Special Districts
15  Elections Act of 1994, W.S. 22-29-101 through 22-29-408.

17       (c)  Project – Wheatland Water Supply Rehabilitation

 3  connect the improvements to the town's water system and
 4  appurtenances necessary to make the project function in the

 7              (iv)  Total project budget: Eight hundred fifty-
 8  four thousand dollars ($854,000.00);

 9 

10              (v)  Project grant: The state of Wyoming shall
11  grant to the sponsor from water development account I
12  through the commission for the design, permit procurement,
13  project land procurement, construction engineering, and
14  construction of the project an amount not to exceed two
15  hundred twenty-two thousand dollars ($222,000.00) or
16  twenty-six percent (26%) of the actual development costs,
17  whichever is less;

19              (vi)  Appropriation: There is appropriated from
20  water development account I to the commission two hundred
21  twenty-two thousand dollars ($222,000.00) or as much
22  thereof as is necessary to carry out the purpose of this
23  subsection. Unexpended funds appropriated under this

 1  subsection shall revert to water development account I on
 2  July 1, 2005; and

 4              (vii)  Special condition: The sponsor is
 5  responsible for acquiring seventy-four percent (74%) of the
 6  total project budget from other sources.

10       99-3-504.  Level III construction projects-
11  rehabilitation.

13       (a)  Authorization is granted for the Level III
14  rehabilitation construction projects identified in this

16  W.S. 99-3-104.

18       (b)  Project – Baggs Water Supply Rehabilitation

21              (i)  Project sponsor: Town of Baggs;

23              (ii)  Project purpose: Municipal and domestic

 3  facilities and other miscellaneous appurtenances necessary
 4  to make the project function in the manner intended;

 6              (iv)  Total project budget: One hundred eighty-
 7  four thousand dollars ($184,000.00);

 9              (v)  Project grant: The state of Wyoming shall
10  grant to the sponsor from water development account II
11  through the commission for the design, permit procurement,
12  project land procurement, construction engineering, and
13  construction of the project an amount not to exceed ninety-
14  two thousand dollars ($92,000.00) or fifty percent (50%) of
15  the actual development costs, whichever is less;

17              (vi)  Appropriation: There is appropriated from
18  water development account II to the commission ninety-two
19  thousand dollars ($92,000.00) or as much thereof as is
20  necessary to carry out the purpose of this subsection.
21  Unexpended funds appropriated under this subsection shall
22  revert to water development account II on July 1, 2005; and

19              (iv)  Total project budget: Two hundred seventy-
20  six thousand dollars ($276,000.00);

22              (v)  Project grant: The state of Wyoming shall
23  grant to the sponsor from water development account II
24  through the commission for the design, permit procurement,

 2  construction of the project an amount not to exceed one
 3  hundred thirty-eight thousand dollars ($138,000.00) or
 4  fifty percent (50%) of the actual development costs,

 4              (iii)  Project description: Final design
 5  services, plans and specifications, for rehabilitating the
 6  South Crow Dam, for adding a supervisory control and data
 7  acquisition control system, for pipelines needed to connect
 8  to the city's treatment and conveyance system and for
 9  appurtenances necessary to make the project function in the
10  manner intended;

11 

12              (iv)  Total project budget: Seventy thousand
13  dollars ($70,000.00);

14 

15              (v)  Project loan: The state of Wyoming shall
16  loan to the sponsor from water development account II
17  through the commission for final design, plans and
18  specifications of the project an amount not to exceed
19  thirty-five thousand dollars ($35,000.00) or fifty percent
20  (50%) of the actually development costs, whichever is less,
21  for a term of twenty (20) years from the date the
22  commission determines project benefits accrue to the
23  sponsor, at an annual rate of seven and one-quarter percent
24  (7.25%);

 2              (vi)  Project grant: The state of Wyoming shall
 3  grant to the sponsor from water development account II
 4  through the commission for the final design, plans and
 5  specifications for the project an amount not to exceed
 6  thirty-five thousand ($35,000.00) or fifty percent (50%) of
 7  the actual development costs, whichever is less; and

 8 

 9              (vi)  Appropriation: There is appropriated from
10  water development account II to the commission seventy
11  thousand dollars ($70,000.00) or as much thereof as is
12  necessary to carry out the purpose of this subsection.
13  Unexpended funds appropriated under this subsection shall
14  revert to water development account II on July 1, 2005.

16       (e)  Project – Dayton Water Supply  Rehabilitation
17  Project:

18 

19              (i)  Project sponsor: Town of Dayton;

20 

21              (ii)  Project purpose: Municipal and rural
22  domestic water supply;

 1              (iii)  Project description: Replacement of an
 2  existing transite pipeline, installation of a new booster
 3  station, installation of pipeline to an existing booster
 4  station and appurtenances necessary to make the project
 5  function in the manner intended;

 7              (iv)  Total project budget: Eight hundred eighty
 8  thousand dollars ($880,000.00);

 9 

10              (v)  Project grant: The state of Wyoming shall
11  grant to the sponsor from water development account II
12  through the commission for the design, permit procurement,
13  project land procurement, construction engineering, and
14  construction of the project an amount not to exceed four
15  hundred forty thousand dollars ($440,000.00) or fifty
16  percent (50%) of the actual development costs, whichever is
17  less;

19              (vi)  Appropriation: There is appropriated from
20  water development account II to the commission four hundred
21  forty thousand dollars ($440,000.00) or as much thereof as
22  is necessary to carry out the purpose of this subsection.
23  Unexpended funds appropriated under this subsection shall
24  revert to water development account II on July 1, 2005; and

 2              (vii)  Special condition: The sponsor is
 3  responsible for securing fifty percent (50%) of the project
 4  budget from other sources.

 6       (f)  Project – Encampment Raw Water Line
 7  Rehabilitation Project:

 9              (i)  Project sponsor: Town of Encampment;

10 

11              (ii)  Project purpose: Municipal and domestic
12  water supply;

13 

14              (iii)  Project description: Final design
15  services, plans and specifications, for the replacement of
16  the remaining nonpiped portion of the raw water conveyance
17  system extending from the North Fork of the Encampment
18  River to the town's water system and for appurtenances
19  necessary to make the project function in the manner
20  intended;

21 

22              (iv)  Total project budget: Sixty thousand
23  dollars ($60,000.00);

 1              (v)  Project loan: The state of Wyoming shall
 2  loan to the sponsor from water development account II
 3  through the commission for final design, plans and
 4  specifications of the project an amount not to exceed
 5  thirty thousand dollars ($30,000.00) or fifty percent (50%)
 6  of the actual development costs, whichever is less, for a
 7  term of twenty (20) years from the date the commission
 8  determines project benefits accrue to the sponsor, at an
 9  annual rate of seven and one-quarter percent (7.25%);

11              (vi)  Project grant: The state of Wyoming shall
12  grant to the sponsor from water development account II
13  through the commission for the final design, plans and
14  specifications for the project an amount not to exceed
15  thirty thousand dollars ($30,000.00) or fifty percent (50%)
16  of the actual development costs, whichever is less; and

17 

18              (vii)  Appropriation: There is appropriated from
19  water development account II to the commission sixty
20  thousand dollars ($60,000.00) or as much thereof as is
21  necessary to carry out the purpose of this subsection.
22  Unexpended funds appropriated under this subsection shall
23  revert to water development account II on July 1, 2005.

10  services, plans and specifications, for improving fire
11  flows, meeting Safe Drinking Water Act minimum pressure and
12  disinfection requirements and for appurtenances necessary
13  to make the project function in the manner intended;

15              (iv)  Total project budget: One hundred fifty
16  thousand dollars ($150,000.00);

17 

18              (v)  Project grant: The state of Wyoming shall
19  grant to the sponsor from water development account II
20  through the commission for the final design, plans and
21  specifications for the project an amount not to exceed
22  seventy-five thousand ($75,000.00) or fifty percent (50%)
23  of the actual development costs, whichever is less;

12       (h)  Project – Hugus-Mullison Ditch Rehabilitation
13  Project:

15              (i)  Project sponsor: Hugus Watershed Improvement
16  District;

18              (ii)  Project purpose: Irrigation, seepage and
19  flood control;

21              (iii)  Project description: Canal lining,
22  replacement of culverts at street crossings to increase the
23  capacity of the ditch and appurtenances necessary to make
24  the project function in the manner intended;

 2              (iv)  Total project budget: Six hundred fifty
 3  thousand dollars ($650,000.00);

 4 

 5              (v)  Project grant: The state of Wyoming shall
 6  grant to the sponsor from water development account II
 7  through the commission for the design, permit procurement,
 8  project land procurement, construction engineering, and
 9  construction of the project an amount not to exceed three
10  hundred twenty-five thousand dollars ($325,000.00) or fifty
11  percent (50%) of the actual development costs, whichever is
12  less;

14              (vi)  Appropriation: There is appropriated from
15  water development account II to the commission three
16  hundred twenty-five thousand dollars ($325,000.00) or as
17  much thereof as is necessary to carry out the purpose of
18  this subsection. Unexpended funds appropriated under this
19  subsection shall revert to water development account II on
20  July 1, 2005; and

22              (vii)  Special condition: The sponsor is
23  responsible for acquiring fifty percent (50%) of the total

10  right-of-way acquisition, final design services, plans and
11  specifications required to rehabilitate an existing twenty
12  (20) inch diameter pipeline, to add additional storage
13  facilities in east Laramie, to connect the east side
14  storage to the Laramie water system, and for appurtenances
15  necessary to make the project function in the manner
16  intended;

18              (iv)  Total project budget: Nine hundred seventy
19  thousand dollars ($970,000.00);

20 

21              (v)  Project loan: The state of Wyoming shall
22  loan to the sponsor from water development account II
23  through the commission for permit procurement, right-of-way
24  acquisition, final design, plans and specifications of the

 1  project an amount not to exceed four hundred eighty-five
 2  thousand dollars ($485,000.00) or fifty percent (50%) of
 3  the actual development costs, whichever is less, for a term
 4  of twenty (20) years from the date the commission

 6  annual rate of seven and one-quarter percent (7.25%);

 8              (vi)  Project grant: The state of Wyoming shall
 9  grant to the sponsor from water development account II
10  through the commission for permit procurement, right-of-way
11  acquisition, final design, plans and specifications of the
12  project an amount not to exceed four hundred eighty-five
13  thousand dollars ($485,000.00) or fifty percent (50%) of
14  the actual development costs, whichever is less; and

16              (vii)  Appropriation: There is appropriated from
17  water development account II to the commission nine hundred
18  seventy thousand dollars ($970,000.00) or as much thereof
19  as is necessary to carry out the purpose of this
20  subsection. Unexpended funds appropriated under this
21  subsection shall revert to water development account II on
22  July 1, 2005.

 9  installation of pipelines to connect the town's existing
10  well directly to the storage system, to tie the storage
11  system to the distribution system and appurtenances
12  necessary to make the project function in the manner
13  intended;

15              (iv)  Total project budget: Two hundred thirty-
16  five thousand dollars ($235,000.00);

17 

18              (v)  Project loan: The state of Wyoming shall
19  loan to the sponsor from water development account II
20  through the commission for the design, permit procurement,
21  project land procurement, construction engineering, and
22  construction of the project an amount not to exceed one
23  hundred seventeen thousand five hundred dollars
24  ($117,500.00) or fifty percent (50%) of the actual

 1  development costs, whichever is less, for a term of thirty
 2  (30) years from the date the commission determines project
 3  benefits accrue to the sponsor, at an annual rate of seven
 4  and one-quarter percent (7.25%);

 6              (vi)  Project grant: The state of Wyoming shall
 7  grant to the sponsor from water development account II
 8  through the commission for the design, permit procurement,
 9  project land procurement, construction engineering, and
10  construction of the project an amount not to exceed one
11  hundred seventeen thousand five hundred dollars
12  ($117,500.00) or fifty percent (50%) of the actual
13  development costs, whichever is less; and

14 

15              (vii)  Appropriation: There is appropriated from
16  water development account II to the commission two hundred
17  thirty-five thousand dollars ($235,000.00) or as much
18  thereof as is necessary to carry out the purpose of this
19  subsection. Unexpended funds appropriated under this
20  subsection shall revert to water development account II on
21  July 1, 2005.

23       (m)  Project – Powell Water Supply Rehabilitation

 7              (iii)  Project description: Right-of-way
 8  acquisition, final design services, including permitting
 9  services and providing plans and specifications, for
10  replacing an old water storage tank, for providing
11  miscellaneous piping and pressure reducing valves to create
12  additional pressure zones to comply with the Safe Drinking
13  Water Act's minimum pressure requirements and for
14  appurtenances necessary to make the project function in the
15  manner intended;

17              (iv)  Total project budget: Two hundred fifty-
18  four thousand dollars ($254,000.00);

19 

20              (v)  Project grant: The state of Wyoming shall
21  grant to the sponsor from water development account II
22  through the commission for the right-of-way acquisition,
23  final design, plans and specifications for the project an
24  amount not to exceed one hundred twenty-seven thousand

 1  dollars ($127,000.00) or fifty percent (50%) of the actual
 2  development costs, whichever is less;

 4              (vi)  Appropriation: There is appropriated from
 5  water development account II to the commission one hundred

 7  thereof as is necessary to carry out the purpose of this
 8  subsection. Unexpended funds appropriated under this
 9  subsection shall revert to water development account II on

 3  raw water conveyance system which serves the Riverton
 4  Valley Irrigation District, the LeClair Irrigation
 5  District, and the City of Riverton and for appurtenances
 6  necessary to make the project function in the manner
 7  intended;

 9              (iv)  Total project budget: One hundred seventy
10  thousand dollars ($170,000.00);

11 

12              (v)  Project grant: The state of Wyoming shall
13  grant to the sponsor from water development account II
14  through the commission for the final design, plans and
15  specifications for the project an amount not to exceed
16  eighty-five thousand dollars ($85,000.00) or fifty percent
17  (50%) of the actual development costs, whichever is less;

19              (vi)  Appropriation: There is appropriated from
20  water development account II to the commission eighty-five
21  thousand dollars ($85,000.00) or as much thereof as is
22  necessary to carry out the purpose of this subsection.

 2  refinancing of an existing state land and investment board
 3  emergency loan that funded the replacement of an old three
 4  (3) inch diameter transmission line, funding of the
 5  replacement of another existing transmission pipeline from
 6  the water supply well to town and appurtenances necessary
 7  to make the project function in the manner intended;

 8 

 9              (iv)  Total project budget: Two hundred eighty
10  thousand dollars ($280,000.00);

11 

12              (v)  Project grant: The state of Wyoming shall
13  grant to the sponsor from water development account II
14  through the commission for refinancing the state land and
15  investment board emergency loan for replacing an existing
16  three (3) inch diameter pipeline, and for the design,
17  permit procurement, project land procurement, construction
18  engineering, and construction of a new rehabilitation
19  project an amount not to exceed one hundred forty thousand
