Involuntary commitment procedures-authorized recordings.

A BILL
for
1 AN ACT relating to
involuntary commitment proceedings;
2 requiring
commitment hearings to be recorded by specified
3
means; and providing for an effective date.

5 Be It Enacted by the Legislature of the State of Wyoming:

7 Section 1. W.S. 25-10-110(h) is amended to read:
8
9 25-10-110. Involuntary hospitalization proceedings.
10
11 (h) The
proposed patient, the applicant, and all
12 others to whom notice is required may appear
at the hearing
13 to testify and may present witnesses. The
court may receive
14 the testimony of other persons. The proposed
patient shall
15 be present at the hearing unless he waives
his right to
16 appear. All persons not necessary to protect
the rights of
17 the parties shall be excluded from the
hearing. The hearing

shall be conducted in as informal a manner as is consistent
2
with orderly procedure and in a physical setting which will
3 not
have a harmful effect on the mental health of the
4
proposed patient. Any hearing conducted under
this
5 subsection shall be recorded by the court reporter or by
6 electronic, mechanical or other appropriate means.
7
8 Section 2. This act is effective July 1, 2001.
