A BILL

 

for

 

 1  AN ACT relating to railroads; requiring trains to be
 2  operated by a crew of not less than two persons as
 3  specified; providing a definition; and providing for an
 4  effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 37-9-506 is created to read:

 9 

10         37-9-506.  Railroad train crews.

11 

12         (a)  Except as otherwise provided in this section, no
13  railroad train may be operated in this state unless the
14  train has a crew of at least two (2) competent employees.
15  At least one (1) of the employees on the crew shall be a

 1  certified engineer and at least one (1) of the employees on
 2  the crew shall be a certified conductor.

 3 

 4         (b)  The provisions of this section shall not apply to
 5  the extent they are contrary to or inconsistent with a
 6  regulation or order of the federal railroad administration
 7  of the United States department of transportation.

 8 

 9         (c)  As used in this section, "certified engineer"
10  means a person certified as a train service engineer,
11  locomotive servicing engineer or student engineer in
12  accordance with 49 C.F.R. Part 240.

13 

14         Section 2.  This act is effective July 1, 2001.
