A BILL

 

for

 

 1  AN ACT relating to state lands; eliminating maximum term
 2  limit on industrial, commercial and recreational leases;
 3  authorizing residential leases; modifying rental value
 4  determinations as specified; and providing for an effective
 5  date.

 6 

 7  Be It Enacted by the Legislature of the State of Wyoming:

 8 

 9         Section 1.  W.S. 36-5-114(a) and (c) is amended to
10  read:

11 

12         36-5-114.  Leasing for industrial, commercial,
13  residential and recreational purposes; authority; rental
14  fees.

 1         (a)  The board of land commissioners may lease for a
 2  term of not more than twenty-five (25) years, with a
 3  preferential right to renew for successive like periods,
 4  state lands for industrial, commercial, residential and
 5  recreational purposes. Lessees shall have a preferential
 6  right to renew their lease.

 8         (c)  The board shall fix a rental value on the basis
 9  of a definite amount per acre based upon of not less than
10  fair market value of each use of the land. If the land to
11  be leased under this subsection was originally acquired by
12  the state for the benefit of the common school permanent
13  land fund, and is to be used by a Wyoming school district
14  for the construction and maintenance of school buildings
15  and facilities, the board may assess an annual rental fee
16  of one hundred dollars ($100.00) per acre or not less than
17  fair market value, whichever is less.

19         Section 2.  This act is effective immediately upon
20  completion of all acts necessary for a bill to become law
21  as provided by Article 4, Section 8 of the Wyoming
22  Constitution.
