A BILL

 

for

 

 1  AN ACT relating to local governments; requiring cities,
 2  towns, counties and school districts to include fringe
 3  benefits when publishing salaries of public officials and
 4  employees; and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 15-1-110(a), (b)(i) and (ii),
 9  18-3-516(a), (b)(i) and (ii) and 21-3-110(a)(ii)(intro) and
10  (A) are amended to read:

11 

12         15-1-110.  Minutes of meetings and titles of
13  ordinances passed to be published; exception; contents;
14  publication of names, benefits, salaries and wages of
15  specified officials and employees; "department head"
16  defined.

 2         (a)  The governing body of any city or town shall
 3  designate a legal newspaper and publish once therein the
 4  minutes of all regular and special meetings of the
 5  governing body and the titles of all ordinances passed. If
 6  a newspaper is not published in the city or town the
 7  proceedings or ordinances shall be posted for at least ten
 8  (10) days in the city or town clerk's office and in such
 9  other places as the governing body determines. The clerk of
10  each city or town shall within twelve (12) days after
11  adjournment of every meeting, furnish the newspaper a copy
12  of the proceedings of the meeting. Except for
fringe
13  benefits, salaries and wages published under subsection (b)
14  of this section, the copy shall include any bill presented
15  to the governing body stating the amount of the bill, the
16  amount allowed, the purpose of the bill and the claimant.
17  Claims for part-time employees may be summarized by
18  department without listing each part-time employee. The
19  newspaper shall publish the copy of proceedings within nine
20  (9) days after receipt.

22         (b)  A city or town required to publish minutes under
23  subsection (a) of this section shall separately publish:

 1              (i)  During January and July of each year, the
 2  name, position
,and gross monthly salary, and fringe
 3  benefits as specified in this paragraph, of each chief
 4  administrative official, assistant administrative official
 5  and department head including elected officials. The
 6  publication shall also include a list of all other full-
 7  time positions employed by the city or town without the
 8  name of the current employee, including the gross monthly
 9  salary
, and fringe benefits as specified in this paragraph,
10  for each position. A brief statement shall accompany the
11  salary publication specifying that all salaries are listed
12  as gross monthly salaries or actual monthly wages,
not
13  including any all fringe benefits such as of health
14  insurance costs, life insurance benefits and pension plans.
15  The statement shall also indicate that the salaries or
16  wages do not include any overtime the employee may earn
17  which would be paid by the city or town; and

18 

19              (ii)  During March of each year, a complete list
20  of all chief administrative officials, assistant
21  administrative officials, elected officials, department
22  heads and full-time employees of the city or town specified
23  by name and position, excluding salaries
and fringe
24  benefits.

 2         18-3-516.  Publication of proceedings; publication of
 3  names, salaries and wages of certain officials and
 4  employees.

 5 

 6         (a)  Each board of county commissioners shall publish
 7  the entire proceedings of all regular and special meetings
 8  held by them one (1) time in a newspaper published in the
 9  county, if any. The county clerk of each county shall
10  within twelve (12) days after adjournment of every meeting,
11  furnish the paper with a copy of the proceedings. Except
12  for
fringe benefits, salaries and wages published under
13  subsection (b) of this section, the copy shall include any
14  bill presented to the board stating the amount of the bill,
15  the amount allowed, the purpose of the bill and the
16  claimant. Claims for part-time employees may be summarized
17  by department without listing each part-time employee. The
18  newspaper shall publish the copy of proceedings within nine
19  (9) days after receipt. The board shall if practicable
20  publish notice of the time of all regular and special
21  meetings.

23         (b)  Each board of county commissioners shall publish
24  separate from the minutes of the proceedings:

14  publication specifying that all salaries are listed as

17  insurance costs, life insurance benefits and pension plans.
18  The statement shall also indicate that the salaries or
19  wages do not include any overtime the employee may earn
20  which would be paid by the county; and

22              (ii)  During March of each year, a complete list
23  of all chief administrative officials, assistant

 1  heads and full-time employees of the county specified by
 2  name and position, excluding salaries
and fringe benefits.

 3 

 4         21-3-110.  Duties of boards of trustees.

 5 

 6         (a)  The board of trustees in each school district
 7  shall:

 8 

 9              (ii)  Keep minutes of all meetings at which
10  official action is taken and a record of all official acts
11  including a record of all warrants issued against the
12  monies belonging to the school district.  The minutes and
13  records shall be public records.  A list of each warrant
14  over five hundred dollars ($500.00) shall be published one
15  (1) time in a legal newspaper of general circulation within
16  the respective county within thirty (30) days of the date
17  of the meeting. Individual yearly gross salary payments
and
18  fringe benefits need be published only once in March of
19  each year:

21                   (A)  Each individual annual gross salary
22  shall be identified by category and each individual salary
23  shall be published as a gross dollar amount without
24  identification other than by category.  Categories shall

 1  include superintendent, assistant superintendent, high
 2  school principal, assistant high school principal, junior
 3  high principal, junior high assistant principals,
 4  elementary principals, elementary assistant principals,
 5  first grade teachers, second grade teachers, third grade
 6  teachers, fourth grade teachers, fifth grade teachers,
 7  sixth grade teachers, kindergarten teachers, high school
 8  departmental teachers (business, language arts, foreign
 9  languages, science, social studies, mathematics, or other),
10  vocal music, instrumental music, elementary music,
11  secondary art, elementary art, secondary physical
12  education, elementary physical education, vocational
13  education, secondary guidance counselors, secondary
14  librarians, elementary librarians, driver education,
15  special education teachers, remedial teachers, nurses,
16  teacher's aides, head coaches, assistant coaches,
17  dramatics, secondary secretarial, junior high secretarial,
18  elementary secretarial, business managers, janitorial, bus
19  drivers, and other categories which may be selected so that
20  every individual salary may be categorized. 
Fringe
21  benefits provided pursuant to W.S. 21-7-301 for each
22  category shall be identified.  Each category shall show a
23  cumulative subtotal and there shall be a grand total of all

 1  categories.  At the end of the salary publication there
 2  shall be printed the district salary schedule;

 3 

 4         Section 2.  This act is effective July 1, 2001.
