A BILL

 

for

 

 1  AN ACT relating to electioneering; providing a penalty for
 2  the untimely release by news media of the results of polls
 3  conducted by the news media; and providing for an effective
 4  date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 22-26-113 is amended to read:

 9 

10         22-26-113.  Electioneering too close to a polling
11  place; release of polls by news media.

13         (a)  Electioneering too close to a polling place on
14  election day consists of any form of campaigning, including
15  the display of campaign signs or distribution of campaign
16  literature, the soliciting of signatures to any petition or

 1  the canvassing or polling of voters, except exit polling by
 2  news media,  within one hundred (100) yards of the building
 3  in which the polling place is located.

 4 

 5         (b)  It shall be a misdemeanor as provided in W.S.
 6  22-26-112(a)(i) for the news media, including but not
 7  limited to, any print media, radio, television and the
 8  internet, to release before all of the polling places in
 9  this state have closed the results of an exit poll
10  conducted under subsection (a) of this section, or of any
11  other similar poll, which projects the outcome of an
12  election within this state for any federal or statewide
13  office when two (2) or more candidates are running for the
14  office.

16         Section 2.  This act is effective July 1, 2001.
