A BILL

 

for

 

 1  AN ACT relating to workers' compensation; amending the
 2  permanent total disability and death benefit awarded to
 3  children under the workers' compensation program as
 4  specified;  and providing for an effective date.

 5 

 6  Be It Enacted by the Legislature of the State of Wyoming:

 7 

 8         Section 1.  W.S. 27-14-403(b) is amended to read:

 9 

10         27-14-403.  Awards generally; method of payment.

11 

12         (b)  Effective July 1, 2001, in the case of permanent
13  total disability or death, each child of an employee shall
14  be paid one hundred dollars ($100.00) one hundred fifty
15  dollars ($150.00) per month until the child dies or reaches
16  the age of majority, whichever first occurs, or if the

 1  child is physically or mentally incapacitated until the
 2  child dies or attains the age of twenty-one (21) years,
 3  whichever first occurs. The amount awarded under this
 4  subsection shall be adjusted for inflation annually by the
 5  division, using the consumer price index of the United
 6  States department of labor, bureau of labor statistics.

 7 

 8         Section 2.  This act is effective July 1, 2001.
