A BILL
for
1 AN ACT relating to
public lands; providing for county and

other entities participation in the emergency fire
3 suppression
account; providing a definition; providing for
4
assessments to participate in the account; repealing
5
provision regarding assessment when account exceeds certain
6
amount; and providing for an effective date.

8 Be It Enacted by the Legislature of the State of Wyoming:
9
10 Section 1. W.S. 36-1-401(a)
by creating a new
11 paragraph (v) and 36-1-404(a),
(b)(intro) and (e) are
12 amended to read:
13
14 36-1-401. Definitions.

16 (a) As used in this article:

1 (v) "Participating
entity" means a fire
2 district, municipal, volunteer or
combined fire department
3 within a participating county.
4
5 36-1-404. Participation by counties;
assessments;
6 withdrawal from
participation; forfeiture of assessments
7 for failure to pay
assessments.

9 (a) Counties desiring to participate in the emergency
10 fire suppression account shall enter into a
written
11 contract with the state forester and shall
pay the
12 assessments provided for in this section. The assessment
13 for a
participating county shall not change due to the
14 participation of
a participating entity within the county.
15
16 (b) Except as provided in subsection (d) of this 17
section,
Each participating county
shall pay an annual
18 assessment to the account in an amount equal
to:
19
20 (e) Any county
electing to participate in the account
21 in any year after
July 1, 1987 may become a participating
22 county by paying an initial assessment equal
to the annual
23 assessment computed for that county under
subsection (b) of
24 this section times
the greatest number of years any other

1 participating county has paid annual assessments into the 2
account multiplied by three (3).

4 Section 2. W.S. 36-1-404(d) is repealed.

6 Section 3. This act is effective July 1, 2001.
